FOR "VICTOR GARDENS 5m ADDITION" WHEREAS, POA -Scherer, LLC. has requested approval of a PUD Amendment to allow construction of 7 townhome units on property legally described as follows: Outlot B, Victor Gardens 2"d Addition. WHEREAS, the Planning Commission has reviewed the PUD amendment for the community activity center at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA -Scherer, LLC. for a PUD general plan amendment, subject to the following conditions: 1. A PUD amendment is approved to allow the creation of 7 townhome units on 2 condo lots, 1 lot for the pool/community center and 1 outlot in accordance with the plans received on December 12, 2005 and on February 2 2006, except as amended by this resolution. 2. The approval is contingent upon City Council approval of the Preliminary Plat. 3. The PUD amendment is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan and the approved Victor Gardens PUD. 4. The plans shall be revised to identify the location of the mailboxes for the townhomes. The mailboxes must be architecturally compatible with the homes in the development. The applicant must submit final plans for review and approval by the City. 5. Cross access and maintenance agreements shall be recorded with the final plat for the shared private street and parking. 6. Private driveways in front of the townhome garages shall be a minimum of 22 feet long to accommodate parking. 7. The shared private street shall be at least 22 feet wide, face to face. No parking is permitted on the shared private street. 8. Sidewalks are required along both sides of all public streets. 9. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for review and approval by the City. Resolution 2006-27 Page 2 10. The developer and/or the owner's association shall be responsible for maintenance of the landscaping and irrigation systems within the development. 11. The homeowner's association documents shall include language to ensure that the enclosed garage spaces are maintained for vehicle parking and that parking of snowmobiles, boats, RVs and other recreational vehicles in the driveway is discouraged. The covenants shall be drafted to prohibit the storage of anything in the garage or driveway that would prevent the storage and parking of vehicles. Such language shall also be included in the Developers Agreement. 12. Residential building materials and architectural details shall be as shown on the townhome elevations and plans received on December 12, 2005. 13. The developer's architectural control committee (ARC) shall review and approve all building designs for compliance with this resolution, prior to building permit submittal. A written copy of the ARC approval shall be submitted with the building permit application for each building. The City shall review the building architecture for compliance with the approved plans prior to issuance of building permits. 14. Exterior lighting shall be consistent throughout the development. All lighting shall be shielded to prevent glare and light trespass, as required by Section 1195.400 of the City Code. 15. All platted townhome lots shall comply with the following setbacks: Front yard from public streets 15 feet Between buildings 20 feet Required Parking for townhomes (mMuding garage stalls 2.5 stalls per unit 16. Prior to final plat approval, the applicant shall provide copies of the HOA documents/covenants for City review. A copy of the covenants shall be filed with the final plat. 17. At the time of final plat submittal, the developer must submit final development plans with the PUD final plan application. 18. The developer must obtain all necessary permits from Rice Creek Watershed District and all other jurisdictional agencies.
