APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE
HOMES FOR WATERS EDGE SOUTH FOURTH ADDITION
WHEREAS, Pulte Homes has requested approval of a Final Plat for "Waters Edge South
Fourth Addition" on property legally described as follows:
Outlot B, Waters Edge South, Washington County, Minnesota according to the
recorded plat thereof
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for Pulte Homes for Waters Edge South Fourth Addition; and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; subject to the following conditions:
1. A final plat is approved to allow the construction of 66 Courtyard townhome
units, in accordance with the plans received by the City on April 7, 2006 and
revisions received on May 1, 2006 except as amended by this resolution.
2. The development agreement must be executed by the developer and the City prior
to release of the final plat.
3. Development standards shall be according to the PUD general plan and
preliminary plat approvals granted by the City Council on May 17, 2004 and as
may be amended. (Resolution 2004-33, Resolution 2004-34 and Ordinance 2004-
391).
4. The following conditions shall be met prior to release of the final plat for filing:
a) The town homes shall be subject to the architectural controls that were created
for the development and previously approved by the City. No adjacent
townhome buildings shall have the same front elevations colors or
architectural styles. Materials and colors of the town homes shall be
consistent with the architectural plans and design palette as approved by the
overall PUD and received by the City on May 4, 2006.
b) HOA documents or written confirmation that the townhomes will be covered
under the HOA established by the previous phases of this development must
be submitted to the City Attorney for review and approval.

c) The HOA documents shall include language stating that maintenance and any
necessary repairs of the private drives, including repairs needed as a result of
public infrastructure projects, shall be the responsibility of the HOA.
d) The HOA shall be responsible for maintenance of sidewalks within the
development.
e) The covenants for this development should include language to make
homeowners aware that the land west of this development is zoned
agriculture, is not planned to urbanize and will include noises, odors and
activities consistent with rural development.
f) Cross access and maintenance agreements as well as drainage and utility
easements shall be recorded with the final plat for all private drives.
g) Park dedication shall be cash in lieu of land dedication for the 66 units in this
phase. Park dedication shall be due based on the park dedication ordinance at
the time the final plat is released for filing at Washington County.
11. The following conditions must be met prior to issuance of building permits:
a) The final plat, development agreement and associated documents must be
recorded at the County.
b) No changes shall be made to the HOA documents unless approved by the City
of Hugo in writing. Any amendments to the HOA documents must be filed at
Washington County.
c) The lighting fixtures type shall be the same style as was provided with the first
phase of this development.
d) The minimum floor elevations shall comply with Section 1175-060.1 of the
Hugo Zoning Ordinance.
e) The development shall comply with the Fire Chief's requirement regarding
fire flow calculations, the location of fire hydrants, fire department
connections and fire lane signage.
f) A site plan shall be submitted for review and verification of setback
requirements and approval by City staff.
g) All platted residential lots shall comply with the following setbacks:

h) The applicant should try to limit the use of Scotch Pine, Marshalls Seedless
Ash and Amur Maple due to concerns about survivability, insect problems and
invasiveness.
i) Exterior lighting shall be consistent throughout the development. All lighting
shall be shielded to prevent glare and light trespass, as required by the Zoning
Ordinance.
j) The maximum driveway curb cut width shall be 24 feet.
k) The developer should provide information detailing how the private drives
would be distinguished from public streets (concrete aprons, signage,
narrower width, etc.) for City review and approval.
1) The developer must obtain all necessary permits from Rice Creek Watershed
District and/or the City of Hugo.
m) The applicant shall comply with the conditions in the City Engineer's memo
dated May 15, 2006.
