FOR "VICTOR GARDENS 6m ADDITION" ON PROPERTY LOCATED SOUTH OF VICTOR GARDENS 4tb ADDITION AND EAST OF VICTOR GARDENS EAST WHEREAS, POA Scherer, LLC. has requested approval of a Final Plat and Final PUD Plan for "Victor Gardens 6h Addition" to allow the construction of 60 homes and 6 outlot on the 44.23 - acre property legally described as follows: Outlot E, Victor Gardens East WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat and final PUD plan for POA Scherer, LLC for Victor Gardens 6`h Addition; and I ` FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; subject to the following conditions: 1. A final plat is approved to allow the construction of 60 single-family units, in accordance with the approved preliminary plat dated March 8, 2006 and the plans received by the City on January 12 and February 13, 2006 except as amended by this resolution. 2. The Final Plat shall be subject to the Preliminary Plat and PUD Amendment approval granted by the City Council on March 20, 2006 and as may be amended. (Resolution # 2006-15). 3. The applicant shall comply with all conditions of PUD concept plan approval (Resolution #2000-47) and the original development agreement dated June 6, 2002. 4. The applicant shall comply with all conditions in the City Engineer's letter dated May 30, 2006. 5. Outlots C -F shall be owned and maintained by the Homeowners Association. The purpose, ownership and maintenance of the outlots created by this plat shall be as follows: a. Outlot A contains the center island for the Provence Way cul-de-sac, is intended to be utilized for private recreational purposes and will be owned and maintained by the homeowner's association. b. Outlot B contains the center island for the Flora Way cul-de-sac, is intended to be utilized for private recreational purposes and will be owned and maintained by the homeowner's association. Resolution 2006-31 Page 2 c. Outlot C contains wetlands, portions of Clearwater Creek (west of Everton Avenue and north of Valjean Boulevard) as well as stormwater pond A. It is intended for preservation and access purposes adjacent to the creek and will be owned and maintained by the homeowner's association. d. Outlot D contains wetlands, portions of Clearwater Creek (west of Everton Avenue and south of Valjean Boulevard) as well as stormwater pond B. It is intended for preservation and access purposes adjacent to the creek and will be owned and maintained by the homeowner's association. e. Oudot E contains wetlands and stormwater pond C. It is intended for preservation and access purposes and will be owned and maintained by the homeowner's association. f. Outlot F contains wetlands, portions of Clearwater Creek (east of Everton Avenue), stormwater pond D and the City lift station. It is intended for preservation and access purposes adjacent to the creek and lift station and will be owned and maintained by the homeowner's association. 6. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. 7. All cul-de-sac streets shall be at least 26 feet wide, face to face, with parking permitted on one side, as shown on the plans. 8. Private driveways in front of the homes shall be a minimum of 22 feet long to accommodate parking. 9. Sidewalks are required along both sides of all public streets, except the cul-de-sacs and bridges. 10. The developer and/or the owner's association shall be responsible for maintenance of the landscaping and irrigation systems within the outlots and public right-of-way. 11. The homeowner's association documents shall include language to ensure that the enclosed garage spaces are maintained for vehicle parking and that parking of snowmobiles, boats, RVs and other recreational vehicles in the driveway is discouraged. The covenants shall be drafted to prohibit the storage of anything in the garage or driveway that would prevent the storage and parking of vehicles. 12. The mailboxes must be architecturally compatible with the homes in the development, as shown in the photos submitted January 12, 2006. 13. Exterior lighting shall be consistent throughout the development. All lighting shall be shielded to prevent glare and light trespass, as required by Section 1195.400 of the City Code. 1 Resolution 2006-31 Page 3 14. The following conditions shall be met prior to release of the final plat for filing: a. The plans shall be revised to provide a drainage and utility easement over the wetlands and stormwater ponds in Outlots C through F. b. The applicant shall comply with all conditions outlined in the City Engineer's memo, dated February 28, 2006. c. Revise the Final PUD plan to show the final floodplain boundary. The trail may not be located within the floodway. d. The crosswalk striping of Valjean Boulevard shall comply with Sheet 1 of the Crosswalk Striping Plan. 16. The following conditions be met prior to issuance of building permits: Resolution 2006-31 Page 4 a. The developer shall submit an irrigation plan for review and approval by the City. b. The applicant shall file the Final Plat, Development Agreement and associated documents at Washington County. Proof of recording must be provided to the City. c. The applicant shall submit one full set of approved final plans to the City. d. The developer's architectural control committee (ARC) shall review and approve all building designs for compliance with this resolution. A written copy of the ARC approval shall be submitted with the building permit application for each building. The City shall review the building architecture for compliance with the approved plans prior to issuance of building permits. e. If a sales trailer is to be located on the property, a site plan and building elevations must be submitted for City review and approval. 17. Prior to release of the applicant's letter of credit or other financial guarantee, the developer shall provide a 20 -foot trail easement over any portion of 10 -foot bituminous trail that is not located within the right-of-way. The trail shall be field -located to minimize tree removal and the easement shall be established over the constructed trail. The applicant must submit the easement document for review and approval by the City Attorney prior to release of the easement for filing at the County.
