APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC. FOR "VICTOR
GARDENS NORTH 4'h ADDITION" ON PROPERTY LOCATED NORTH OF
FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF ELMCREST AVENUE
NORTH
WHEREAS, POA -Scherer, LLC. has requested approval of a preliminary plat to allow
construction of one commercial lot and one outlot on the 5.88 -acre properly legally described as
follows:
Outlot A, Victor Gardens North Village 3"d Addition, Washington County, Minnesota.
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA-
SCHERER, LLC for a preliminary plat, subject to the following conditions:
1. A preliminary plat is approved to allow the creation of one commercial lot and one outlot in
accordance with the application and plans received by the City on June 29, 2006 and
revisions received on July 24, 2006, except as amended by this resolution.
2. Approval is contingent upon the City Council approval of the requested PUD General Plan.
3. Development standards shall be as approved as part of the PUD General Plan.
4. The preliminary plat shall be revised to correctly identify Frenchmen Road as CSAH 8.
5. No undevelopable outlots shall be platted. Outlot A shall be platted as a single lot in the next
phase of development.
6. The preliminary plat shall be revised to show the trail easement along Elmcrest Avenue
North.
7. The preliminary plat shall be revised to show the 20 -foot easement over the sidewalk
adjacent to Street A and the sidewalk through Oudot A. The easement document must be
submitted for review and approval by City staff and must be filed with the final plat. If the
easement document was recorded with Victor Gardens North Village P Addition please
provide a copy of the recorded document for City files.
8. Park dedication requirements for this site have been met with previous additions. No
additional park dedication is required for this phase.
9. The developer shall obtain all necessary permits from the City.

10. The development shall comply with the Fire Chiefs requirements regarding fire flow
calculations, the location of fire hydrants, fire department connections, and fire lane signage.
11. The developer shall comply with all conditions outlined in the City Engineer's memo dated
August 1, 2006.
12. The property is adjacent to CSAH 8, therefore, the developer must obtain preliminary plat
approval from Washington County and comply will all conditions of plat approval.
13. All public improvements and private common improvements required of Victor Gardens
North Village 3'd Addition, to serve the subject lot, including the construction of Street A and
sidewalks, shall be tested and approved by the City prior to the issuance of a certificate of
occupancy on this site.
