HomeMy WebLinkAbout2006.08.21 RESO 2006-0048r .t RESOLUTION 200648 APPROVING A PUD GENERAL PLAN FOR THE POSTAL CREDIT UNION ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF ELMCREST AVENUE NORTH WHEREAS, The Postal Credit Union has requested approval of a PUD General Plan to allow construction of approximately 5,000 square feet of commercial on the 5.88 -acre property legally described as follows: Outlot A, Victor Gardens North Village 3"d Addition, Washington County, Minnesota. WHEREAS, the Planning Commission has reviewed the PUD General Plan at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Postal Credit Union for a PUD General Plan, subject to the following conditions: 1. A PUD General Plan is approved for a bank with 4 drive-through lanes, in accordance with the plans and application received by the City on June 29, 2006, and revised on July 24, 2006, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested Preliminary Plat. 3. The development shall be consistent with the Victor Gardens PUD concept plan approvals (Resolution # 2000-47), except as otherwise noted herein. 4. Development standards for the PUD shall be as indicated on the plans and graphics dated July 24, 2006, except as amended by this resolution. 5. The bank shall comply with the setbacks as shown on the plans. 6. The bank building shall be sprinklered. 7. PUD flexibility is granted to permit 25 parking spaces where 33 are required. 8. PUD flexibility is granted to permit 100 feet of stacking at each drive -though lane where 180 feet is required. 9. Prior to recording of the final plat, the following conditions shall be addressed: a. A PUD final plan shall be submitted for administrative review and approval by the City. b. The master site plan created by Westwood shall be revised to show the sidewalk connection from Street A to the planned trail on CSAH 8. Resolution 2006-48 Page 2 c. All plans must be signed by a registered architect, engineer or designer. d. The site plan shall be revised to provide an additional sidewalk connection between the building and Victor Hugo Boulevard. e. The applicant shall submit cross access and maintenance agreements for the shared private drive for review and approval by the City Attorney. f. The applicant shall comply with all conditions from the City Engineer's memo dated August 1, 2006. g. All mechanical equipment shall be screened as required by Code and the PUD Concept Plan approval. The plans shall be revised to screen the electric transformer and identify where all the other mechanical equipment will be located. h. The building elevations shall be revised to provide greater visual relief and architectural detail on all four sides, including changes to the roofline and variation in the plane of the walls to break up the building mass. The applicant shall work with city staff to ensure that this condition is met. i. Building material samples shall be submitted for City review and approval. The samples shall include colors for shingles, brick and stone. Building colors and materials shall be harmonious with other phases of the Victor Gardens development. j. All signage shall comply with the following conditions: i. No freestanding signage is allowed on the subject property. ii. PUD flexibility is granted to allow two wall signs are permitted for the bank (on the south and west elevations as shown). Each wall sign may not exceed 36 square feet in size. Sign area shall be measured according the Hugo City Code requirements. iii. Details for the directional signage shall be submitted for City review and approval. iv. Directional signs on the canopy shall be permitted as shown. v. Revised sign details shall be submitted for City review and approval. k. The height of the light poles shall be identified. 1. The landscape plan shall be revised to provide shading over 25% of the parking lot within 15 years, as depicted on the landscape plan dated August 3, 2006. 10. Prior to issuance of building permits, the applicant must comply with the following conditions: Resolvtign 2006-48 Page 2 a. The irrigation plan shall be revised to include a note that insures the sprinklers do not spray onto any pavement. b. The operations and easement agreement for Victor Gardens North shall be revised to include the subject site. The revised document shall be submitted for review and approval by the City Attorney. c. The operations and easement agreement shall prohibit the outside sale or storage of merchandise, vehicles, equipment, or other items and to ensure that the tenant are responsible for litter control from the premises and litter control is to occur on a daily basis. d. The applicant shall obtain all necessary local, state, and federal permits. e. The developer's architectural control committee (ARC) shall review and approve the building design prior to building permit submittal. A written copy of the ARC approval shall be submitted with the building permit application. The City shall review the building architecture for compliance with the approved plans prior to issuance of building permits. f. A building permit may be issued once the construction of the common improvements (both public and private) which serve the lot have commenced. 11. All public improvements and private common improvements required of Victor Gardens North Village 3`d Addition, which serve the subject lot, including the construction of Street A and sidewalks, shall be tested and approved by the City prior to the issuance of a certificate of occupancy on this site. 12. Site plan approval is required for the commercial development planned for Oudot A. No development approvals are granted or implied. 13. Commercial development on Outlot A shall comply with all conditions of the Victor Gardens PUD approvals. ADOPTED by the City Council this 21'` day of August 2006 U-0 0:1.1 Vq Mary reager, City Cler
