FOR "VICTOR GARDENS NORTH VILLAGE a ADDITION" ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF ELMCREST AVENUE NORTH WHEREAS, POA -Scherer, LLC. has requested approval of a Final Plat to allow construction of one commercial lot and one outlot on the 5.88 -acre property legally described as follows: Outlot A, Victor Gardens North Village 3"d Addition, Washington County, Minnesota. WHEREAS, the City has prepared a Development Agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA- SCHERER, LLC for a Final Plat; and FURTHER, that the Development Agreement for said plat be approved, and that the Mayor and City Administrator be authorized to execute the Development Agreement on behalf of the City; and FURTHER, that these approvals are subject to the following conditions: 1. A Final Plat is approved to allow the creation of one commercial lot and one outlot in accordance with the plans and application received by the City on July 24, 2006, except as amended by this resolution. 2. Development standards shall be according to the PUD General Plan and Preliminary Plat approvals granted by the City Council on August 21, 2006, and as may be amended. 3. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. 4. The following conditions must be met prior to release of the Final Plat -foe filing with the County: a) The development agreement must be executed by the developer and the City. b) The development shall comply with the Fire Chief's requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. c) The developer must comply with all conditions outlined in the City Engineer's memo dated August 1, 2006. Resolution 2006-49 Page 2 5. The following conditions must be met prior to issuance of building permits: a) The applicant shall submit a Final PUD Plan application for City review and approval. The final development plans shall show compliance with all conditions of approval and shall include a final PUD plan, a final grading, drainage and erosion control plan, a final utility plan, a final landscape plan, and all other plans to be utilized for the construction of the site. b) The applicant must submit one full set of approved final plans to the City. c) The applicant shall file the Final Plat, Development Agreement and associated documents, including the declaration of easements and the sidewalk easement documents, at Washington County. Proof of recording must be provided to the City. d) The operations and easement agreement for Victor Gardens North shall be revised to include the subject site. The revised document shall be submitted for review and approval by the City Attorney. The revised document shall be recorded with the final plat. e) The developer's architectural control committee (ARC) shall review* and approve the building design prior to building permit submittal. A written copy of the ARC approval shall be submitted with the building permit application. The City shall review the building architecture for compliance with the approved plans prior to issuance of building permits. f) The applicant shall obtain all necessary local, state, and federal permits. g) A building permit may be issued once the construction of the common improvements (both public and private) which serve the lot have commenced. 6. All common improvements and requirements of Victor Gardens North Village 3'd Addition, which serve the subject lot, including the construction of Street A and sidewalks, shall be tested and approved by the City prior to the issuance of a certificate of occupancy on this site.
