APPROVING FINDINGS OF FACT DENYING VARIANCE TO FOR A SIDE
YARD SETBACK FOR A GARAGE ADDITION AT 6061144" STREET NORTH
WHEREAS, Jason Schwieger has requested a variance to locate a garage six feet from
the side property line where ten feet is required by ordinance on property described as
follows:
Lot 6, Block 2, Rice Lake Meadows Third Addition, Washington County.
WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at
a duly called public meeting and recommended denial, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variance
requested by Jason Schwieger for property located at 6061 140 Street North based on
the following findings:
1. The applicant has not identified a unique hardship that would warrant the granting
of the requested variances.
2. The strict enforcement of the ordinance would not cause undue hardship because
the applicant has a garage of reasonable size.
3. The applicant's desire to increase the garage is a self-created hardship and is not
unique to this individual parcel.
4. The spirit and intent of the ordinance would not be met because the proposed
garage would extend four feet into the required setback, reducing the amount of
open space intended by the ordinance.
5. The request will change the character of the neighborhood.
