APPROVING FINDINGS OF FACT DENYING REQUEST TO VACATE THE
DRAINAGE AND UTILITY EASEMENT OVER PROPERTY LOCATED AT
14189 FINALE AVENUE NORTH.
WHEREAS, Alice Waller has requested the vacation of the drainage and utility easement
located on her property described as follows:
Lot 15, Block 3, Oneka Estates, Washington County.
WHEREAS, the City Council has reviewed the vacation request at a duly called public
meeting, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the vacation
of the drainage and utility easement requested by Alice Waller on property located at
14189 Finale Avenue North based on the following findings:
1. The easement was created to include property located within 100 feet from the
centerline of Clearwater Creek according to Rule E of the Rice Creek Watershed
District.
2. The easement is necessary for flood control and protection of water quality.
3. The applicant would like to construct a chain-link fence within the drainage and
utility easement.
4. Fences that do not obstruct drainage are permitted within drainage and utility
easements
5. The applicant has not demonstrated a need for the vacation of the drainage and
utility easement.
