HomeMy WebLinkAbout2006.12.18 RESO 2006-0075RESOLUTION 2006-75 APPROVING FINDINGS OF FACT DENYING THE REQUEST FOR APPROVAL OF A RECLAMATION PLAN FOR RICHARD CARRON ON PROPERTY LOCATED AT 14420 IRISH AVENUE NORTH WHEREAS, Richard Carron operates a gravel mining operation on property LOCATED AT 14420 Irish Avenue North WHEREAS, The mining operation is subject to the terms of a mining permit, a Conditional Use Permit, and a settlement agreement that require complete reclamation of the property in accordance with an approved reclamation plan by November 1, 2004, and; WHEREAS, The City has approved a reclamation plan dated February 14, 1997 for the property that prepared by Sunde Engineering, Inc., and; WHEREAS, The property has not been reclaimed in accordance with the approved reclamation plan, and; WHEREAS, Richard Carron has requested approved of a revised reclamation plan dated November 6, 2006, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the reclamation plan dated November 6, 2006 as requested by Richard Carron based on the following findings: 1. The plan indicates that no additional reclamation work will be achieved, other than the eventual removal of several stockpiles of various materials 2. The plan contains no timeframe for any reclamation activity. 3. The plan is inconsistent with the approved 1997 reclamation plan. 4. The plan fails to require the spreading of 4" of topsoil across all disturbed areas. 5. The plan fails to require the preparation of the seedbed 6. The plan fails to require the spreading of fertilizers 7. The plan fails to require the spreading of grass seed 8. The plan fails to require the application of mulch 9. The plan fails to require the planting of tree seedings Resolution 2007- 16' Page 2 10. The plan fails to identify several stockpiles of materials on the property. 11. The plan fails to include requirements for the removal of pavement from the property 12. Implementation of the plan will result in the site being left as an unreclaimed open gravel pit. 13. The plan is opposed to the intentions outlined in the approved Conditional Use Permit, the mining permit and the settlement agreement.
