APPROVING A PUD GENERAL PLAN FOR POA-SCHERER, LLC. FOR
"VICTOR GARDENS NORTH" ON PROPERTY LOCATED NORTH OF
FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF ELMCREST
AVENUE NORTH
WHEREAS, POA -Scherer, LLC has requested approval of a PUD General Plan to allow
construction of 186 townhomes and approximately 69,900 square feet of commercial on a
the 46.43 -acre property legally described as follows:
Outlot A, Victor Gardens, Washington County, Minnesota.
WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly
called Public Hearing and recontmends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by POA -Scherer, LLC for a PUD general plan, subject to the following
conditions:
1. A PUD general plan/site plan is approved to allow the creation of 186 townhomes
(including 8 twinhomes), 1 commercial lot and 2 outlots in accordance with the
preliminary plat submittal received by the City on February 15, 2005, except as
amended by this resolution.
2. Approval is contingent upon City Council approval of the requested preliminary plat.
3. The development shall be consistent with the Victor Gardens PUD concept plan
approvals (Resolution # 2000-47), except as otherwise noted herein.
4. Development standards for the PUD shall be as indicated on the plans dated February
15, 2005 and graphics dated February 2, 2005, except as amended by this resolution.
5. All platted townhome lots (including twinhomes) shall comply with the following
setbacks:
Front yard from public street
15 feet
Between buildings
20 feet
Setback around the perimeter of the site
exterior property lines
30 feet
From commercial property line
15 feet
Required parking for townhomes
(including garage stalls)
2.5 stalls per unit
6. The grocery/retail building shall comply with the setbacks shown on the plans.

7. All townhome and commercial buildings must be sprinklered. Twinhome buildings
are not required to be sprinklered.
8. PUD flexibility is permitted for a 7 -foot encroachment upon the 30 -foot side yard
setback requirement by the grocery building along the east property line.
9. At the time of final plat approval for each phase of the development, the applicant
shall submit final development plans for the review and approval of the City staff.
10. Prior to final plat approval, the applicant must comply with the following conditions:
Architecture
a. Mechanical equipment for the townhomes and commercial uses must be screened
as shown on the plans.
b. The plans shall be revised to identify the location of the mailboxes for the
townhomes. The mailboxes must be architecturally compatible with the homes in
the development. Final plans must be submitted for review and approval by the
City.
c. All block within the development shall be integral colored. No painted CMU will
be permitted.
d. Commercial building materials and architectural details shall be as shown on the
plans received on February 10, 2005.
e. Residential building materials and architectural details shall be as shown on the
townhome plans received on January 28, 2005 and the twinhome plans received
on January 24, 2005.
1) The developer shall submit a design palette (including material samples)
for the entire project for City review and approval. The palette shall
include colors for siding, shakes, shutters, shingles, brick and stone.
Building colors and materials shall be harmonious throughout the
development.
2) No adjacent home shall have the same front elevation colors or
architectural styles. Materials shall be consistent with the architectural
plans and design palette required as part of the PUD approvals.
Trash and Recycling
f. Trash and recycling areas shall be as shown on the plans.

g. The developer shall submit a written plan for how trash/recycling will be handled
to ensure that the retail enclosure is convenient and appropriately sized. No
exterior dumpster or container storage shall be allowed.
h. Trash and recycling areas for future phases must be designed internal to the
building or as an integral part of the building. The development standards must
include this requirement.
Signage
i. A master sign plan must be submitted for review and approval by the City. The
plan must address the following:
1) PUD flexibility is permitted for the 80 -square foot freestanding monument
signs where 40 -foot is the maximum sign area allowed. One sign only shall
be permitted for the commercial development east of Victor Hugo
Boulevard and a second sign shall be permitted for the commercial
development west of Victor Hugo Boulevard. No other freestanding
signage shall be allowed on site.
2) One development identification sign (with no tenant signage) shall be
allowed on each side of the entrance to the development on Victor Hugo
Boulevard. The two signs shall be consistent with the submitted plans.
3) The development identification signs must be set back 8 feet from the
property line, except that a zero -setback will be allowed adjacent to CSAH
8. Sight -visibility must be maintained at intersections.
4) The freestanding monument signs must be set back at least 10 feet from the
property lines.
5) The applicant must revise the freestanding monument sign elevation to
reflect the actual height (22 feet versus the 20 feet shown).
6) The applicant must identify, in square feet, the total amount of area the wall
signs will consume and how the wall signage meets City requirements.
7) The applicant must submit revised sign criteria to better regulate tenant
signage according to the City's requirements.
Parks and Trails
j. The sidewalk connection on the east side of the grocer shall be relocated to
eliminate the grocery drive crossing.

k. The developer must work with the City and County to provide pedestrian
connections to the CSAH 8 trail.
1. Trails and sidewalks shall be as shown on the plans dated February 15, 2005.
in. The sidewalks along Victor Hugo Boulevard and the planned future trail on
Elmcrest shall connect to the planned trail south of CSAH 8. The developer shall
work with the City and County to ensure these connections are made.
n. Park dedication requirements for this site have been met with previous additions.
No additional park dedication is required for this phase.
Streets, Access and Parking
o. Public street dedication shall be as shown on the plans.
p. The developer must submit a streetscape plan with details for paving, sidewalks
and cross walks for review and approval by the City.
q. Diverter islands at each entrance to the roundabout must be provided to insure
that traffic maintains the correct directional flow. The developer shall work with
staff to finalize this design.
r. The sidewalks around the island must be moved back, away from the edge of
roadway, to increase pedestrian safety.
s. The turning radii must be dimensioned at the right -in to the commercial portion of
the development and at the roundabout to ensure that trucks have sufficient
turning space.
t. The developer shall work with the City to finalize signage and other means to
direct traffic at the right -in at the commercial entrance from Victor Hugo
Boulevard.
u. Private driveways in front of the townhome garages shall be 22 feet long to
accommodate parking.
v. No parking is permitted on the shared drives, except as shown on the approved
parking plan dated February 2, 2005.
w. Cross access and maintenance agreements shall be recorded with the final plat for
the shared private drives and parking.
x. An easement agreement from the property owner to the east must be filed with the
final plat to allow construction of the new public street (Street A) and other off-
site improvements.

y. The development agreement for Victor Gardens includes provisions whereby the
applicant is responsible for half of the cost of a traffic signal at the Victor Hugo
Boulevard/CSAH 8 intersection. The signal is slated for construction as part of
the CSAH 8 improvements. In the interim, a temporary traffic signal may be
necessary. If so, the applicant will be responsible for the entire cost based on the
provision of the development agreement.
z. The applicant shall deposit an amount in an escrow account with the City equal to
the cost to construct one-half of a standard City street for the Elmcrest Avenue
frontage.
Landscaping and Open Space
aa. The City grants the applicant a waiver from the Victor Gardens Concept Plan
approvals (Resolution 2000-47) requiring 25 percent shade in the parking lot
within 15 years. The retail development in this phase is approved in accordance
with the landscape plan, subject to the following:
1) The applicant must revise the landscaping plans to provide the calculation
for what percentage of the parking lot will be shaded within 15 years.
2) All future phases shall be subject to the conditions as approved in
Resolution 2000-47 regarding parking lot shading.
bb. Open space as shown on the plans shall be owned and maintained by the HOA.
cc. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan
for review and approval by the City.
dd. The developer and/or the owner's association shall be responsible for
maintenance of the landscaping and irrigation systems within the development.
ee. Landscape details for the foundation plantings around the pylon and monument
signs must be submitted.
ff. Landscaping along the CSAH 8 frontage shall be coordinated with the
CSAR 8 landscape plan, and is subject to further review prior to approval of the
final plat.
Miscellaneous
gg. The residential site plan must also be revised to dimension the required and
proposed building setbacks.
hh. Emergency vehicle accesses must comply with City requirements. Details on
these accesses shall be provided for City review and approval.
ii. The applicant shall comply with all conditions from the City Engineer's memo
dated February 2, 2005.

11. Prior to recording the final plat, the applicant must comply with the following
conditions:
a. The existing drainage and utility easement over the outlot shall be vacated.
12. Prior to issuance of building permits, the applicant must comply with the following
conditions:
a. The applicant shall provide copies of the development covenants for City review.
A copy of the covenants shall be filed with the final plat.
b. The homeowner's association documents shall include language to ensure that the
enclosed garage spaces are maintained for vehicle parking and that parking of
snowmobiles, boats, RVs and other recreational vehicles in the driveway is
discouraged. The covenants shall be drafted to prohibit the storage of anything in
the garage or driveway that would prevent the storage and parking of vehicles.
Such language shall also be included in the Developers Agreement.
c. The homeowner's association documents and sales information shall note that the
property to the north is zoned Agricultural (AG) and that the intent of this district
is to provide an area for the production of livestock, dairy animals, dairy products,
poultry or poultry products, fur -bearing animals, horticultural or nursery stock,
fruit, vegetables, forages, grains, timber, trees, or bees and apiary products, and
other uses dependent on the inherent productivity of the land.
d. The developer's architectural control committee (ARC) shall review and approve
all building designs for compliance with this resolution, prior to building permit
submittal. A written copy of the ARC approval shall be submitted with the
building permit application for each building. The City shall review the building
architecture for compliance with the approved plans prior to issuance of building
permits.
e. The applicant shall obtain all necessary local, state, and federal permits.
f. The applicant must execute a cross access agreement with the property to the east
for the private "frontage" road in the commercial portion of the development.
This frontage road must be constructed when the east -west road (Street A)
connects to Everton.
g. The applicant shall pay their portion of the Everton Avenue Study AUAR costs,
based on the area of the Victor Gardens North Village project site ($17,097.32).
13. Staff will monitor the tenants within the development to ensure that adequate parking
is provided as tenants are finalized.

14. Site plan approval is required for the commercial development planned for outlots A
and B. No development approvals are granted or implied.
15. Commercial development on outlots A and B shall comply with all conditions of the
Victor Gardens PUD approvals.
16. The developer shall work with the developer to the east to provide additional loading
dock screening for the grocery to the extent possible.
