APPROVING A FINAL PLAT FOR CENTEX HOMES AND PRATT
INVESTMENT FOR "HERITAGE PONDS 2ND ADDITION" ON PROPERTY
LOCATED EAST OF ELMCREST AVENUE, WEST OF EVERTON AVENUE
AND NORTH OF COUNTY ROAD 8EAST OF GOODVIEW AVENUE AND
SOUTH OF 149H STREET
WHEREAS, Centex Homes and Pratt Investment have requested approval of a final plat
to allow construction of 27 single-family homes and 120 townhome units on property
legally described as follows:
Outlot A and Outlot B, Heritage Ponds, Washington County, Minnesota.
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Centex Homes and Pratt Investment for a final plat; and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording of the final plat:
1. A final plat is approved to allow the creation of 27 single family lots and 120
townhome units in accordance with the application received by the City on February
3, 2005, and revisions received on February 18, 2005, except as amended by this
resolution.
2. The applicant shall comply with the development standards in the preliminary plat
and PUD general plan approved by resolutions 2004-26 and 2004-27.
3. The development agreement must be executed by the developer and the City prior to
release of the final plat.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. One full set of approved plans must be submitted to the City.
2. Homeowner association documents, cross access and maintenance agreements for
shared private driveways or streets, and drainage and utility easements for all private
drives must all be recorded with the final plat.
3. All platted residential lots shall comply with the following setbacks:

4. The townhomes must be the Carriage and Cottage Row type units, as approved with
the preliminary plat.
5. Both the single-family homes and the townhomes must comply with the design
palette and guidelines previously submitted.
6. All building elevations shall receive nearly equal treatment and visual qualities.
7. No adjacent home shall have the same front elevation colors or architectural styles.
Materials shall be consistent with the architectural plans and design palette required
as part of the PUD approvals.
Landscaping and Lighting
8. The developer shall work with the City to establish guidelines. for crosswalks... ..
9. Lighting fixtures shall be the same type as used throughout the rest of the
development.
10. Exterior lighting shall be consistent throughout the development. All lighting shall be
shielded to prevent glare and light trespass, as required by Section 1174-140.1 of the
Zoning Ordinance. Lighting details should be submitted for City review and
approval.

Streets, Parking and Utilities
11. The maximum driveway curb cut width shall be 24 feet.
12. Cross access and maintenance agreements shall be recorded with the final plat for all
shared private driveways or streets.
13. Drainage and utility easements shall be recorded with the final plat for all private
drives.
14. Additional guest parking shall be provided in the northwest portion of the side to
provide convenient access to the townhomes.
15. The development shall comply with the Fire Chief s requirements regarding fire now
calculations, the location of fire hydrants, fire department connections, and fire lane
signage.
Parks/Open Space
16. The plans should be revised to identify the private recreational space required for the
townhomes.
17. Park dedication requirements were fulfilled with the first phase of this development
when Outlots B and F were dedicated to the City. Outlot B is being replatted as
Outlot B of Heritage Ponds 2"d Addition. No additional park dedication is due.
18. The developer shall construct the public trail within Outlot B.
19. The developer shall construct the planned overlook in Outlot C.
20. The developer shall remove the existing barn on Oudot B.
Drainage/Stormwater Management
21. The applicant shall obtain approval of the land development plan by the Rice Creek
Watershed District, including the proposed wetland impacts and mitigation.
22. The minimum floor elevations shall comply with Section 1175-060.1 of the Hugo
Zoning Ordinance.
23. The applicant shall resolve all remaining issues with final street and utility plans
according to the City Engineer's comments dated March 10, 2005.
