HomeMy WebLinkAbout2005.03.21 RESO 2005-0012t RESOLUTION 2005-12 APPROVING A FINAL PLAT FOR E&G DEVELOPMENT FOR "DIAMOND POINT EAST" ON PROPERTY LOCATED EAST OF GOODVIEW AVENUE AND SOUTH OF 145TH STREET WHEREAS, E&G Development has requested approval of a final plat to allow construction of 125 homes on property legally described as follows: The south half of the south half of the southeast quarter of the northwest quarter of Section 21, Township 31, Range 21 together with an easement over the north 33 feet of the east 1940 feet of the southwest quarter of Section 21, Township 31, Range 21 for purposes of ingress and egress. AND The southwest quarter of Section 21, Township 31, Range 21. WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by E&G Development for a final plat; and FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording of the final plat: 1. A final plat is approved to allow the creation of 125 single family lots and 2 outlots, in accordance with the application received by the City on January 10, 2005, and revisions received on February 18, 2005, except as amended by this resolution. 2. The applicant shall comply with the development standards of the preliminary plat and PUD approvals granted by Resolutions 2003-34 and 2003-35. 3. The dedication of the parkland to the City must be recorded with the final plat. 4. The development agreement must be executed by the developer and the City prior to release of the final plat. FURTHER, that the following conditions be met prior to issuance of building permits: 1. One full set of approved plans must be submitted to the City. 2. Homeowner association documents, cross access and maintenance agreements for shared private driveways or streets, and drainage and utility easements for all private drives must all be recorded with the final plat. 3. All platted residential lots shall comply with the following setbacks: Resolution 2005-12 Page 2 Minimum lot width 80 feet Minimum lot width for detached townhomes in Diamond Point East 60 feet Minimum front yard setbacks 25 feet Minimum side yard setbacks 10 feet Minimum rear yard setbacks 30 feet Setback around the perimeter of the site exterior property lines 30 feet Setback from OHW of Egg Lake 75 feet Setback from OHW of Rice Lake 150 feet Maximum Impervious Surface Area 25% Architectural and Design standards 4. The design palette for the detached townhomes shall be approved by the City approval prior to issuance of building permits. The palette shall include colors for siding, shakes, shutters, shingles, brick and stone. Building colors and materials shall be harmonious throughout the development. 5. No adjacent home shall have the same front elevation colors or architectural styles. 6. The detached townhomes shall be subject to the architectural review and design guidelines which were created for the development. Landscaping and Lighting 7. The HOA shall be responsible for maintenance of the 145a' Street median landscaping and irrigation. 8. The irrigation plan must be submitted for City review and approval prior to issuance of building permit. 9. Lighting fixtures shall be the same as those provided in the Diamond Point West development. Light bases shall comply with City standards. 10. Exterior lighting shall be consistent throughout the development. All lighting shall be shielded to prevent glare and light trespass, as required by Section 1175-140.1 of the Zoning Ordinance. Streets, Parking and Utilities 11. Approval of this development is contingent upon reconstruction of Goodview Avenue. No building permits shall be issued until reconstruction of Goodview Avenue is complete. 12. The plat shall comply with the City's street naming system. Resolution 2005-12 Page 3 13. The shared drives for the detached townhome units shall be no less than 22 feet in length and shall remain unobstructed to accommodate parking. 14. The development shall comply with the Fire Chief s requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. 15. The applicant shall resolve all remaining issues with final street and utility plans according to the City Engineer's comments. 16. The existing well and septic shall be abandoned and municipal utilities shall be extended to serve this property. Sidewalks and Trails 17. Sidewalks/trails shall be as shown on the plans. 18. All sidewalks shall be at least 5 feet in width. 19. The HOA shall be responsible for maintenance of sidewalks within the development. Drainage/Stormwater Management 20. The applicant shall obtain approval of the land development plan by the Rice Creek Watershed District, including the proposed wetland impacts and mitigation. 21. Prior to final plat approval, the applicant must receive all City and watershed approvals for the storm water drainage system. Construction of the required drainage improvements shall be coordinated with improvement to the trunk drainage system. 22. The minimum floor elevation shall comply with Section 1175-060.1 of the Hugo Zoning Ordinance. The applicant shall provide minimum floor elevations for all units to ensure compliance with City requirements. Shoreland Management 23. The developer must obtain all necessary permits from the City of Hugo, Rice Creek Watershed District and Minnesota Department of Natural Resources prior to issuance of building permit.
