RESOLUTION 2005 -15 <br />APPROVING A VARIANCE FOR CONSTRUCTION OF A HOLDING TANK <br />ON PROPERTY LOCATED AT 4510129TH STREET NORTH <br />WHEREAS, David Pepin has requested a variance allow for the construction of a holding <br />tank on property described as follows: <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the request at a <br />duly called Public Meeting and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by David Pepin for a variance for a holding tank, subject to the following <br />conditions: <br />1. A building permit be issued prior to any construction activity on the site. <br />2. Prior to the issuance of a building permit, the holding tank shall be designed to meet <br />all Washington County requirements. <br />3. Prior to the issuance of a building permit, the applicant shall provide a pumping <br />contract with a licensed sewage disposal company. <br />4. Prior to the issuance of a building permit, the applicant shall sign an assessment <br />agreement with the City resulting in covenants running with the land for eventual <br />participation in the construction of a municipal sanitary sewer system to serve the <br />property. <br />5. Within 90 days following completion of a municipal sanitary sewer project to serve <br />this property, the applicant shall remove the holding tank from the site in accordance <br />with City, County and State requirements, and connect to the sanitary sewer. <br />ADOPTED by the City Council this 4h day of April, 2005. <br />Mayor <br />ATTEST: <br />Mary Afreager, City Clerk; ' <br />
