APPROVING A VARIANCE FOR CONSTRUCTION OF A HOLDING TANK
ON PROPERTY LOCATED AT 4510129TH STREET NORTH
WHEREAS, David Pepin has requested a variance allow for the construction of a holding
tank on property described as follows:
WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the request at a
duly called Public Meeting and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by David Pepin for a variance for a holding tank, subject to the following
conditions:
1. A building permit be issued prior to any construction activity on the site.
2. Prior to the issuance of a building permit, the holding tank shall be designed to meet
all Washington County requirements.
3. Prior to the issuance of a building permit, the applicant shall provide a pumping
contract with a licensed sewage disposal company.
4. Prior to the issuance of a building permit, the applicant shall sign an assessment
agreement with the City resulting in covenants running with the land for eventual
participation in the construction of a municipal sanitary sewer system to serve the
property.
5. Within 90 days following completion of a municipal sanitary sewer project to serve
this property, the applicant shall remove the holding tank from the site in accordance
with City, County and State requirements, and connect to the sanitary sewer.
