RESOLUTION 2005 - 26 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POAC- <br />CRAIN, LLC FOR VICTOR GARDENS 4TH ADDITION ON A PROPERTY <br />LOCATED AT THE SOUTHWEST QUADRANT OF FRENCHMAN ROAD <br />(COUNTY ROAD 8) AND WEST OF EVERTON AVENUE NORTH <br />WHEREAS, POAC-Crain, LLC has requested approval of a Final Plat for "Victor <br />Gardens a Addition" to allow the construction of 92 townhome units on the 23.64 -acre <br />property legally described as follows: <br />That part of the Southeast Quarter of the Northwest Quarter of Section 19, <br />Township 31 North, Range 21 West, Washington County, Minnesota, lying <br />Southerly of the center line of Frenchman road North (a&la County State <br />Aid Highway No. 8). <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for POAC-Crain, LLC. For Victor Gardens 0 Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved in accordance with the plans received by the City on July <br />28, and revised on April 19, 2005, except as amended by this resolution. <br />2. Development standards shall be according to the comprehensive plan amendment, <br />rezoning, PUD amendment and preliminary plat approvals granted by the City <br />Council on April 27, 2004, and as may be amended. <br />3. Park Dedication shall be cash -in -lieu ($165,600) and must be paid. <br />4. The development agreement must be executed by the developer and the city. <br />5. Rice Creek Watershed District must approve the plans. <br />FURTHER, that the following conditions be met prior to issuance of building permits: <br />1. HOA documents must be filed at Washington County. <br />
