HomeMy WebLinkAbout2005.05.02 RESO 2005-0026RESOLUTION 2005 - 26 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POAC- CRAIN, LLC FOR VICTOR GARDENS 4TH ADDITION ON A PROPERTY LOCATED AT THE SOUTHWEST QUADRANT OF FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST OF EVERTON AVENUE NORTH WHEREAS, POAC-Crain, LLC has requested approval of a Final Plat for "Victor Gardens a Addition" to allow the construction of 92 townhome units on the 23.64 -acre property legally described as follows: That part of the Southeast Quarter of the Northwest Quarter of Section 19, Township 31 North, Range 21 West, Washington County, Minnesota, lying Southerly of the center line of Frenchman road North (a&la County State Aid Highway No. 8). WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for POAC-Crain, LLC. For Victor Gardens 0 Addition; and FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved in accordance with the plans received by the City on July 28, and revised on April 19, 2005, except as amended by this resolution. 2. Development standards shall be according to the comprehensive plan amendment, rezoning, PUD amendment and preliminary plat approvals granted by the City Council on April 27, 2004, and as may be amended. 3. Park Dedication shall be cash -in -lieu ($165,600) and must be paid. 4. The development agreement must be executed by the developer and the city. 5. Rice Creek Watershed District must approve the plans. FURTHER, that the following conditions be met prior to issuance of building permits: 1. HOA documents must be filed at Washington County. Resolution 2005-26 Page 2 2. The vacation of 146' Street must be filed at Washington County. 3. The vacation of the ponding and flowage easement must be filed at Washington County. 4. The buildings must be the Gable N architectural style, per the elevations submitted on April 5, 2005. 5. The plans must comply with the City Engineer's comments. 6.
