APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA-
SCHERER, LLC FOR VICTOR GARDENS NORTH VILLAGE
WHEREAS, POA -Scherer has requested approval of a Final Plat for "Victor Gardens
North Village" on property legally described as follows:
Outlot A, Victor Gardens
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for POA -Scherer for Victor Gardens North Village; and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved to allow the creation of one commercial lot and two
commercial outlots, in accordance with the plans received by the City on April 1,
2005, except as amended by this resolution.
2. The grading and drainage issues identified in the April 25, 2005 City Engineer's
memo must be addressed.
3. Drainage and utility easements must be provided over all ponds up to the 100 -
year event elevation.
4. Approval of the final plat is contingent upon approval of the vacation of the
drainage and utility easement over Outlot A, Victor Gardens.
5. The development agreement must be executed by the developer and the City prior
to release of the final plat.
6. Development standards shall be according to the PUD general plan and
preliminary plat approvals granted by the City Council on February 22, 2005, and
as may be amended.
7. Park dedication requirements for this site have been met with previous additions.
No additional park dedication is required for this phase.
8. The developer must obtain preliminary plat approval from Washington County
and comply will all conditions of plat approval.

FURTHER, that a PUD final plan must be submitted for administrative review and
approval prior to issuance of building permits. The following conditions must be
addressed in the PUD final plan application:
1. The developer shall provide a project phasing plan for the entire 46.43 -acre site.
2. Architecture
a. All block within the development shall be integral colored. No painted CMU
will be permitted.
b. Commercial building materials and architectural details shall be as shown on
the preliminary plans received on February 10, 2005. Final construction plans
must be submitted for City review and approval.
3. Signage
a. The applicant must submit a master sign plan for review and approval by the
City.
4. Parks and Trails
a. The sidewalk connection on the east side of the grocer shall be relocated to
eliminate the grocery drive crossing.
b. The developer must work with the City and County to provide pedestrian
connections to the CSAH 8 trail.
c. The sidewalks along Victor Hugo Boulevard and the planned future trail on
Elmcrest shall connect to the planned trail south of CSAH 8. The developer
shall work with the City and County to ensure these connections are made.
5. Streets, Access and Parking
a. The developer must submit a streetscape plan with details for paving,
sidewalks and cross walks for review and approval by the City.
b. The developer shall work with the City to finalize signage and other means to
direct traffic at the right -in at the commercial entrance from Victor Hugo
Boulevard.
c. Cross access and maintenance agreements shall be recorded with the final plat
for the shared private drives and parking.
d. An easement agreement from the property owner to the east must be filed with
the final plat to allow construction of the new public street (Street A) and
other off-site improvements.

e. The development agreement for Victor Gardens includes provisions whereby
the applicant is responsible for half of the cost of a traffic signal at the Victor
Hugo Boulevard/CSAH 8 intersection. The signal is slated for construction as
part of the CSAH 8 improvements. In the interim, a temporary traffic signal
may be necessary. If so, the applicant will be responsible for the entire cost
based on the provision of the development agreement.
f. The applicant shall deposit an amount in an escrow account with the City
equal to the cost to construct one-half of a standard City street for the
Elmcrest Avenue frontage.
6. Landscaping and Open Space
a. The City grants the applicant a waiver from the Victor Gardens Concept Plan
approvals (Resolution 2000-47) requiring 25 percent shade in the parking lot
within 15 years. The retail development in this phase is approved in
accordance with the landscape plan, subject to the following:
1) The applicant's plan shows 14.6 percent shading in the grocery
parking lot within 15 years.
2) All future phases shall be subject to the conditions as approved in
Resolution 2000-47 regarding parking lot shading.
b. landscaped areas shall be irrigated. The developer shall submit an irrigation
plan for review and approval by the City.
c. The developer and/or the owner's association shall be responsible for
maintenance of the landscaping and irrigation systems within the
development.
d. Landscape details for the foundation plantings around the pylon and
monument signs must be submitted.
e. Landscaping along the CSAH 8 frontage shall be coordinated with the CSAH
8 landscape plan, and is subject to further review prior to approval of the final
plat.
7. Miscellaneous
a. The developer must comply with all conditions outlined in the City Engineer's memo
dated April 25, 2005.
b. The applicant shall provide copies of the development covenants for City review. A copy
of the covenants shall be filed with the final plat.
c. The developer's architectural control committee (ARC) shall review and approve all
building designs for compliance with this resolution, prior to building permit submittal.
A written copy of the ARC approval shall be submitted with the building permit

application for each building. The City shall review the building architecture for
compliance with the approved plans prior to issuance of building permits.
d. The applicant shall obtain all necessary local, state, and federal permits.
e. The applicant must execute a cross access agreement with the property to the east for the
private "frontage" road in the commercial portion of the development. This frontage road
must be constructed when the east -west road (Street A) connects to Everton.
f. The applicant shall pay their portion of the Everton Avenue Study AUAR costs, based on
the area of the Victor Gardens North Village project site ($17,097.32).
