FOR VICTOR GARDENS NORTH VILLAGE 2ND ADDITION WHEREAS, The Rottlund Comany, Inc. has requested approval of a Final Plat for "Victor Gardens North Village 2 Addition" on property legally described as follows: Outlot A, Victor Gardens, according to the recorded plat thereof, Washington County, Minnesota, EXCEPT that part lying southerly of the following described line: Commencing at the southeast corner of said Outlot A; thence north 00 degrees 27 minutes 16 seconds east, assumed bearing along the east line of said Outlot A, a distance of 855.16 feet to the point of beginning of the line to be described, thence westerly along a non tangential curve, concave to the south having a central angle of 38 degrees 08 minutes 28 seconds, a radius of 590.00 feet and on an arc distance of 392.76 feet, the chord of said curve bears north 82 degrees 39 minutes 27 seconds, a radius of 8 7. 00 feet and on arc distance of 212.06 feet the chord of said curve bears south 78 degrees 16 minutes 29 seconds; thence south 78 degrees 16 minutes 29 seconds west, not tangent to said curve, a distance of 27.18 feet, thence westerly along a tangential curve concave to the north having a central angle of 21 degrees 46 minutes 49 seconds, a radius of 570.00 feet and an arc distance of 21668 feet; thence north 79 degrees 56 minutes 42 seconds west, tangent said curve, a distance of 11 7.56feet; thence westerly along a tangential curve concave to the south, having a central angle of 9 degrees 40 minutes 16 seconds, a radius of 830.00 feet and an arc distance of 140.10 feet; thence north 89 degrees 36 minutes 58 seconds west, tangent to said curve, a distance of 182.90 feet to the west line of said Outlot A and said line there terminating. WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does ayprove the final plat for The Rottlund Company, Inc. for Victor Gardens North Village 2 Addition; and FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow the creation of 10 condominium lots for 82 townhomes, 1 common lot and 1 outlot for future development, in accordance with the plans received by the City on May 26, 2005 and June 16, 2005, except as amended by this resolution. Resolution 2005-37 Page 2 2. The items identified in the June 27, 2005 City Engineer's memo must be addressed. 3. The development agreement must be executed by the developer and the City prior to release of the final plat. 4. Development standards shall be according to the PUD general plan and preliminary plat approvals granted by the City Council on February 22, 2005, and as may be amended. 5. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. 6. The developer must obtain preliminary plat approval from Washington County and comply will all conditions of plat approval. FURTHER, that a PUD final plan must be submitted for administrative review and approval prior to issuance of building permits. The following conditions must be addressed in the PUD final plan application: 1. The developer shall provide a project phasing plan for the entire 46.43 -acre site. 2. At the time of final plat approval for each phase of the development, the applicant shall submit final development plans for the review and approval of the City staff. 3. All platted townhome lots (including twinhomes) shall comply with the following setbacks: Front yard (from public street) 15 feet Between buildings 20 feet Setback around the perimeter of the site (exterior property lines) 30 feet From commercial property line 15 feet Required parking for townhomes (including garage stalls) 2.5 stalls per unit 4. All townhome buildings must be sprinklered. Twinhome buildings are not required to be sprinklered. 5. Architecture a. The plans shall be revised to identify the location of the mailboxes for the townhomes. The mailboxes must be architecturally compatible with the homes in the development. The applicant must submit final plans for review and approval by the City. s Resolution 2005-37 Page 3 b. Residential building materials and architectural details shall be as shown on the townhome plans received on January 28, 2005 and the twinhome plans received on January 24, 2005. 1) The developer shall submit a design palette (including material samples) for the entire project for City review and approval. The palette shall include colors for siding, shakes, shutters, shingles, brick and stone. Building colors and materials shall be harmonious throughout the development. 2) No adjacent home shall have the same front elevation colors or architectural styles. Materials shall be consistent with the architectural plans and design palette required as part of the PUD approvals. 6. Signage a. No development signage for the residential portion is requested. If development signage is requested for the residential portion of the project, a master sign plan must be submitted for review and approval by City staff. 7. Parks and Trails a. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. 8. Streets, Access and Parking a. Cross access and maintenance agreements shall be recorded with the final plat for the shared private drives and parking. b. Private driveways in front of the townhome garages shall be 22 feet long to accommodate parking. c. No parking is permitted on the shared drives, except as shown on the approved parking plan dated February 2, 2005. 9. Landscaping and Open Space a. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for review and approval by the City. b. The developer and/or the owner's association shall be responsible for maintenance of the landscaping and irrigation systems within the development. c. Open space as shown on the plans shall be owned and maintained by the HOA. L'V Resolution 2005-37 Page 4 10. Miscellaneous a. The applicant shall provide copies of the development covenants for review and approval by the City Attorney. A copy of the covenants shall be filed with the final plat. b. The homeowner's association documents shall include language to ensure that the enclosed garage spaces are maintained for vehicle parking and that parking of snowmobiles, boats, RVs and other recreational vehicles in the driveway is discouraged. The covenants shall be drafted to prohibit the storage of anything in the garage or driveway that would prevent the storage and parking of vehicles. Such language shall also be included in the Developers Agreement. c. The homeowner's association documents and sales information shall note that the property to the north is zoned Agricultural (AG) and that the intent of this district is to provide an area for the production of livestock, dairy animals, dairy products, poultry or poultry products, fur -bearing animals, horticultural or nursery stock, fruit, vegetables, forages, grains, timber, trees, or bees and apiary products, and other uses dependent on the inherent productivity of the land. d. The developer's architectural control committee (ARC) shall review and approve all building designs for compliance with this resolution, prior to building permit submittal. A written copy of the ARC approval shall be submitted with the building permit application for each building. The City shall review the building architecture for compliance with the approved plans prior to issuance of building permits. e.
