RESOLUTION 2004-3
APPROVING FINDINGS OF FACT FOR REZONING FOR MASTERPIECE
HOMES, INC. FOR "NORTHERN PINES" ON PROPERTY LOCATED AT THE
NORTHEAST QUADRANT OF HIGHWAY 61 AND 125' STREET
WHEREAS, Masterpiece Homes, Inc. has requested reclassification of the zoning from
R-3 (Single Family Detached Residential) to PUD (Planned Unit Development) for a
12.3 -acre parcel, legally described as follows:
All that part of the southeast quarter of the northeast quarter of Section 31
Township 31 north, Range 21 west of the fourth principal meridian, lying
east of the east line of Lake Superior and Mississippi Railroad Company's,
a corporation, right-of-way as described in that certain Document of
Record dated February 12, 1874, recorded April 24, 1878 in the Book of
Deeds Number Three (3) at page one hundred and seventy-three (173) and
filed in the office of the County Recorder of Washington County in the
State of Minnesota
Except that part taken for U.S. Highway No. 61.
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from
R-3 to PUD;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request
by Masterpiece Homes, Inc. for the reclassification of the zoning from R-3 to PUD for
the 12.3 -acre property, based on the following findings:
1. The proposed rezoning is consistent with the Comprehensive Plan and other City
policies and plans. The development would allow twinhomes at a net density of 3.2
units per acre, which is consistent with the Comprehensive Plan and Zoning
Ordinance requirements.
2. The proposed development meets the intent of the PUD zoning district by providing
an efficient use of land by using reduced setbacks to preserve additional setbacks
along Highway 61. Additional landscaping is provided to mitigate the impact of the
reduced setback.
3. The PUD will allow a more creative and efficient approach to land use within the
City, while at the same time protecting and promoting the health, safety, comfort,
aesthetics, economic viability and general welfare of the City.

4. The proposed development meets the intent of the PUD zoning district by creating an
integrated neighborhood, lifecycle housing opportunities, additional landscaping and
increased setbacks from Highway 61 that would not otherwise be possible through a
strict interpretation of the Zoning Ordinance.
5. The PUD would provide appropriate transitions between differing land uses within
the site and adjacent land uses.
6. The development would incorporate common design elements. The buildings would
have common design elements and similar landscape materials would be used
throughout the development.
7. There is adequate infrastructure to support the proposed rezoning and development.
8. The PUD will improve the efficiency of public streets and utilities by upgrading the
existing 125m Street with a bituminous overlay.
