HomeMy WebLinkAbout2004.03.01 RESO 2004-0010RESOLUTION 2004-10 APPROVING A CONDITIONAL USE PERMIT FOR GENE'S DISPOSAL SERVICE, INC. PROPERTY LOCATED AT 5661152ND STREET NORTH. WHEREAS, Gene and Lisa Wegleitner have requested approval of a conditional use permit to allow exterior storage in an area exceeding the size of the principal building and operate a recycling center on a 1.6 -acre property legally described as follows: Insert Legal WHEREAS, the Planning Commission has reviewed the conditional use permit at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Gene and Lisa Wegleitner for a conditional use permit, subject to the following conditions: 1. The conditional use permit is approved in accordance with the plans and application received by the City on January 29, 2004, except as amended by this resolution. 2. The portion of the site on which the sorting and storage of recyclable material will occur must be protected by a concrete pad or bituminous, as approved by the City. 3. Vehicles shall be stored inside the building or on an improved surface, such as bituminous and concrete. 4. Areas of the site not covered with buildings or improved surfaces should be landscaped. A landscape plan should be submitted for staff review and approval. 5. A contiguous and uniform fence that is effective in visually screening the property from adjacent properties and the public right-of-way shall surround the entire property. The applicant shall erect a fence of the same type and height along the border of the property that is not currently fenced and replace the plastic slats in the existing fence so that the fence is contiguous and uniform in its screening effectiveness. A revised site plan shall be submitted for City review and approval. 6. The site currently contains debris that shall be removed by the applicant before beginning operations. 7. Storing and storage of materials and containers shall only be permitted in the areas identified in the approved site plan. 8. All recycling materials must remain in covered containers. No outside storage of recycling shall be permitted. 9. The site must be maintained in a clean, odor -free manner at all times. The applicant shall be responsible for maintaining a site free of litter and debris. Resolution 2004-10 Page 2 10. The site must be connected to sanitary sewer within 12 months. 11. The applicant must revise the site plan to comply provide the required number of parking spaces for this site. A minimum of 9 parking spaces are required for the disposal business plus additional parking for the rear portion of the building. The parking spaces must be paved and striped in conformance with ordinance requirements. New parking areas must have curb and gutter. 12. A revised site plan, which identifies setbacks, well, septic and all structures, must be submitted. 13. A grading and paving plan must be submitted for staff review and approval. 14. City approval is required prior to occupying the rear portion of the building to ensure that adequate parking and access is available in compliance with City standards.
