HomeMy WebLinkAbout2004.03.01 RESO 2004-0011RESOLUTION 2004-11 DENYING A VARIANCE FOR GENE'S DISPOSAL SERVICE, INC. FOR PROPERTY LOCATED AT 5661152ND STREET NORTH. WHEREAS, Gene and Lisa Wegleitner have requested approval of a variance to allow exterior storage on an unpaved surface for a recycling facility on a 1.6 -acre property legally described as follows: Insert Legal WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should not and hereby does deny the request by Gene and Lisa Wegleitner for a variance to allow exterior storage on an unpaved surface for a recycling facility, based on the following findings: 1. There are no unique circumstances affecting this property that would cause an undue hardship for the applicant. Paving of the site would be a condition of approval for any new or relocated business of this type. While paving the site may create a financial impact for this applicant, the hardship is not unique to this property. 2. The storage of garbage/recycling container and storing recycling materials on a gravel surface has the potential to contaminate the site and create unsightly conditions. 3. The property could be put to reasonable use without the variance. 4. Granting the variance has the potential to contaminate the site and create performance standard issues.
