HomeMy WebLinkAbout2004.04.05 RESO 2004-0014RESOLUTION 2004-14 APPROVING PRELEM INARY PLAT FOR OAKWOOD LAND DEVELOPMENT FOR "BEAVER PONDS SOUTH" FOR PROPERTY LOCATED SOUTH OF 128H STREET AND NORTH OF 125' STREET WHEREAS, Oakwood Land Development has requested approval of a preliminary plat to allow construction of 45 homes on property legally described as follows: The southeast quarter of the northwest quarter of Section 32, Township 31, Range 21, except the south 652 feet thereof, Washington County, Minnesota. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Oakwood Land Development for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 41 single family lots and one lot to be dedicated to the City for park land, in accordance with the plans and application received by the City on January 9, 2004 and January 20, 2004, except as amended by this resolution. 2. Development is subject to the R-3 district standards. No variances are granted or implied. 3. The park dedication land shall be deeded to the City with the final plat. 4. Sidewalks or trails shall be provided according the Park Commission recommendation. 5. The Preliminary Plat shows an easement over the southern half of Block 5 to be vacated. The applicant will need to provide the necessary legal description and proof of vacation prior to Final Plat approval. 6. The developer shall submit a light plan with fixture details for City review prior to final plat. 7. A revised landscape plan shall be submitted and shall address the following: a. The species of trees shall be identified. b. The deciduous trees shall be a minimum of 2.5 -inches in diameter. c. No more than 25 percent of the deciduous trees shall be of any one species. Resolution 2004-14 Page 2 8. Additional freeboard is required adjacent to the infiltration area on Sites 1-5 in Block 1. The low floor elevations sites 1- 5 should be established at 941.5 and the low building opening elevations should be established at elevation 942.5. 9. A wetland delineation and report shall be provided for City review. The wetland in the southeast corner of the site cannot be delineated until spring. The delineated edge will need to be defined and avoided during all phases of grading and construction. 10. The applicant shall work with City staff to revise the pond and rear -yard swale design to make it less susceptible to problems in the future. 11. The developer shall pay the City their share of the costs of the Beaver Ponds lift station according to the existing agreement. The cost-sharing will be outlined in the Developers Agreement. 12. Prior to approval of the final plat, the water system shall be evaluated by the City Engineer using the City's water system model to verify that the extension of the water system will not result in anticipated operating pressures or fire flows below the required minimums. The applicant shall work with staff to ensure adequate flows are provided. ° 13. The developer must obtain all necessary permits from Rice Creek Watershed District and Minnesota Department of Natural Resources. 14. The development shall comply with the Fire Chiefs requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. 15. The developer shall comply with all City requirements as noted in the comments from the City water resource engineer and the City Engineer, including the following: a. Centerline curve data should be shown on the plans. b. Fondant Trail shall be named Fondant Trail North. c. Hydrant locations should be shown. Hydrants must have a 250' coverage radius. d. Sewer and water main stubs shall be extended to the property line. e. Sewer structures shall be labeled. f. Final grade elevations should be should be shown at all property comers. g. Typical street section should show 24" select granular borrow under the 12" Class V aggregate. h. 12" Class V aggregate should extend V behind back of curb. i. The standard City bituminous trail section should be shown on the plan. 16. The developer shall work with the City to finalize the road design in the northeast corner of the site to provide safe circulation without increased maintenance costs. "Resolution 2004-14 Page 3 17. Staff will work with the developer to identify the exact location and design of the parking lot. The developer shall prepare a concept plan for a parking lot for review by the Parks Commission and City Council. A paving plan shall also be prepared for Council review and approval. The City may enter into a cost sharing agreement with the developer to pave the parking area being constructed by the developer. 18. Flay Avenue should be signed for no parking on the north side of the street. Staff will monitor the parking situation and provide a report to the City Council.
