RESOLUTION 2004-16 <br />APPROVING FINAL PLAT FOR MASTERPIECE HOMES FOR NORTHERN <br />PINES ON PROPERTY LOCATED EAST HIGHWAY 61 AND NORTH OF 125 <br />STREET <br />WHEREAS, Masterpiece Homes has requested approval of a final plat to allow <br />construction of 38 homes on the 12.3 -acre property legally described as follows: <br />All that part of the southeast quarter of the northeast quarter of Section 31, <br />Township 31 north, Range 21 west of the fourth principal meridian, lying <br />east of the east line of Lake Superior and Mississippi Railroad Company's, <br />a corporation, right-of-way as described in that certain Document of <br />Record dated February 12, 1874, recorded April 24, 1878 in the Book of <br />Deeds Number Three (3) at page one hundred and seventy-three (173) and <br />filed in the office of the County Recorder of Washington County in the <br />State of Minnesota <br />Except that part taken for U.S. Highway No. 61. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Masterpiece Homes for Northern Pines; and <br />FURTHER, that the development agreement for said plat shall be completed by the City <br />Attorney and the Mayor and City Administrator be authorized to execute the <br />development agreement on behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of 38 homes, in accordance with the <br />plans received by the City on February 10, 2004 and revisions received on March 16, <br />2004 and April 8, 2004, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior to <br />release of the final plat. <br />3. Development standards shall be according to the PUD general plan and preliminary <br />plat approvals granted by the City Council on January 5, 2004. The developer must <br />comply with all conditions of approval prior to issuance of building permits. <br />
