HomeMy WebLinkAbout2004.04.19 RESO 2004-0016RESOLUTION 2004-16 APPROVING FINAL PLAT FOR MASTERPIECE HOMES FOR NORTHERN PINES ON PROPERTY LOCATED EAST HIGHWAY 61 AND NORTH OF 125 STREET WHEREAS, Masterpiece Homes has requested approval of a final plat to allow construction of 38 homes on the 12.3 -acre property legally described as follows: All that part of the southeast quarter of the northeast quarter of Section 31, Township 31 north, Range 21 west of the fourth principal meridian, lying east of the east line of Lake Superior and Mississippi Railroad Company's, a corporation, right-of-way as described in that certain Document of Record dated February 12, 1874, recorded April 24, 1878 in the Book of Deeds Number Three (3) at page one hundred and seventy-three (173) and filed in the office of the County Recorder of Washington County in the State of Minnesota Except that part taken for U.S. Highway No. 61. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Masterpiece Homes for Northern Pines; and FURTHER, that the development agreement for said plat shall be completed by the City Attorney and the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow the construction of 38 homes, in accordance with the plans received by the City on February 10, 2004 and revisions received on March 16, 2004 and April 8, 2004, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City prior to release of the final plat. 3. Development standards shall be according to the PUD general plan and preliminary plat approvals granted by the City Council on January 5, 2004. The developer must comply with all conditions of approval prior to issuance of building permits. I Resolution 2004-16 Page 2 4. Final grading plans shall be submitted for review and approval by the City prior to release of the final plat. Elevations should be shown on the corner of all units. 5. The developer must obtain all necessary permits from Rice Creek Watershed District. 6. The developer shall comply with all requirements from the City Engineer. 7. The landscape plan must be revised to provide a minimum of 39 deciduous trees at least 2.5 -inches in diameter. 8. The park dedication shall be cash -in -lieu of dedication and shall be due prior to filing the final plat. 9. The applicant shall provide copies of the HOA documents/covenants for City review.
