FOR "VICTOR GARDENS COMMUNITY ACTIVITY CENTER" ON OUTLOT B OF VICTOR GARDENS 2" ADDITION WHEREAS, POA -Scherer, LLC. has requested approval of a PUD Amendment to allow construction of a community activity center with a pool on property legally described as follows: Oudot B, Victor Gardens 2"d Addition. WHEREAS, the Planning Commission has reviewed the PUD amendment for the community activity center at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA -Scherer, LLC. for a PUD general plan amendment, subject to the following conditions: 1. A PUD amendment is approved to allow the construction of a community activity center with a pool, in accordance with the plans received on March 4, and revised on March 25, 2004, except as amended by this resolution. 2. The PUD amendment is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan and the approved Victor Gardens PUD. 3. A conditional use permit is approved to allow the encroachment of the pool into the floodplain, based on the finding that the proposed project meets all standards and criteria required by Section 1155.030 of the Land Use Regulations and the following: a. The developer must comply with floodplain use construction standards as required by Subd. 5 of Section 1155-030.1. b. An elevation certificate must be provided. 4. The applicant shall provide copies of section of the HOA documentstcovenants which cover the pool for City review. 5. Prior to final approval, detailed building elevations for all sides of the building should be provided for City review. All building elevations shall receive nearly equal treatment and visual qualities. Resolution 2004-19 Page 2 6. The building shall be of high quality and constructed with durable materials. Major exterior surfaces of all walls shall be hardi-board, vinyl siding or shake and brick or stone. 7. The developer must obtain all necessary permits from Rice Creek Watershed District and all other jurisdictional agencies. ADOPTED by the City Council this P day of May 2004.
