APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR POAC-CRAIN,
LLC. FOR "VICTOR GARDENS 4TH ADDITION" ON PROPERTY LOCATED
AT THE SOUTHWEST QUADRANT OF EVERTON AVENUE NORTH AND
FRENCHMAN ROAD (COUNTY ROAD 8)
WHEREAS, the POAC-Crain, LLC. has requested a comprehensive plan amendment to
change the 20.37 -acre residential portion of the site from Commercial to High -Density
Residential, with respect to the 23.64 -acre property, legally described as follows:
That part of the Southeast Quarter of the Northwest Quarter of Section 19, Township
31 North, Range 21 West, Washington County, Minnesota, lying Southerly of the
center line of Frenchman Road North (a/k/a County State Aid Highway No. 8).
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request for a comprehensive plan amendment for the above -referenced property, based on
the following findings and subject to the following conditions:
1. The property is located with the urban service area where municipal sewer and
water are available.
2. The property is unique with regard to its physical characteristics and the wetland
locations within the site that lends itself less to commercial development than
residential.
3. There is adequate commercial land remaining in other areas to meet the needs of
the City.
4. There is adequate public infrastructure to serve the site.
5. Approval of the amendment would have no negative fiscal impact upon the City.
ADOPTED by the City Council this 3'd day of May 2004.
