APPROVING FINDINGS OF FACT FOR REZONING FOR POAC-CRAIN, LLC.
FOR "VICTOR GARDENS 4TH ADDITION" ON PROPERTY LOCATED AT
THE SOUTHWEST QUADRANT OF EVERTON AVENUE NORTH AND
FRENCHMAN ROAD (COUNTY ROAD 8)
WHEREAS, POAC-Crain, LLC has requested reclassification of the zoning from C-2
(General Business) to PUD (Planned Unit Development) for a 23.64 -acre property,
legally described as follows:
That part of the Southeast Quarter of the Northwest Quarter of Section 19,
Township 31 North, Range 21 West, Washington County, Minnesota,
lying Southerly of the center line of Frenchman road North (a/k/a County
State Aid Highway No. 8).
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from
C-2 to PUD;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request
by POAC-Crain, LLC for the reclassification of the zoning from C-2 to PUD for the
23.64 -acre property, based on the following findings:
1. The proposed rezoning is consistent with the Comprehensive Plan, if amended, and
other City policies and plans.
2. The development would allow townhomes at a net density of 9.7 units per acre, which
is consistent with the original PUD plan and Zoning Ordinance requirements.
3. The PUD will allow a more creative and efficient approach to land use within the
City, while at the same time protecting and promoting the health, safety, comfort,
aesthetics, economic viability and general welfare of the City.
4. The PUD would provide appropriate transitions between differing land uses within
the site and adjacent land uses. The proposed development would simply be an
expansion of the existing Victor Gardens development to the west.

5. The development would incorporate common design elements. The buildings would
have common design elements and similar landscape materials would be used
throughout the development. The Victor Gardens design standards would be
incorporated into the development.
6. There is adequate infrastructure to support the proposed rezoning and development.
ADOPTED by the City Council this 3'd day of May 2004.
