APPROVING A PUD AMENDMENT FOR POAC-CRAIN, LLC. FOR "VICTOR
GARDENS 4TH ADDITION" ON PROPERTY LOCATED AT THE
SOUTHWEST QUADRANT OF EVERTON AVENUE NORTH AND
FRENCHMAN ROAD (COUNTY ROAD 8)
WHEREAS, POAC-Crain, LLC has requested approval of a PUD Amendment to allow
construction of 92 townhome units on a portion of the 23.64 -acre property legally
described as follows:
That part of the Southeast Quarter of the Northwest Quarter of Section 19,
Township 31 North, Range 21 West, Washington County, Minnesota,
lying Southerly of the center line of Frenchman road North (a/k/a County
State Aid Highway No. 8).
WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly
called Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by POAC-Crain, LLC for a PUD general plan amendment, subject to the
following conditions:
1. A preliminary plat is approved to allow the creation of 92 townhomes, 9 common lots
and two commercial lots in accordance with the plans received on March 22, 2003,
except as amended by this resolution.
2. Approval is contingent upon City Council approval of the requested comprehensive
plan amendment, rezoning and preliminary plat.
3. Development standards for the PUD shall be as indicated on the plans dated March
22, 2004, except as amended by this resolution.
4. All platted townhome lots shall comply with the following setbacks:
Front yard from public street
15 feet
Between buildings
20 feet
Setback around the perimeter of the site
exterior property lines
30 feet
From commercial property line
15 feet
Required Parking for townhomes

2.5 stalls per unit
5. The applicant should work with staff to revise the landscape plan to provide the
maximum possible number of coniferous trees, to meet the intent of the ordinance.
Specifically, the trees species should be water tolerant species to be planted near the
wetlands.

6. All trees to be preserved shall be staked with tree protection fencing prior to
beginning any site work.
7. Monument sign details shall be submitted for City review and approval prior to filing
the final plat.
8. The applicant should work with the City to provide safe pedestrian access within the
development, including the possible striping the new public streets at their
intersections with pedestrian crosswalks.
9. Architectural elevations of all buildings (type, color and materials used on all exterior
surfaces) shall be submitted for City review and approval.
10. When the commercial buildings are developed, all building elevations shall receive
equal treatment and visual qualities. There shall be no underdeveloped backside to
the buildings.
11. When the commercial buildings are developed, the buildings shall be of high quality
and constructed with durable materials. Major exterior surfaces of all walls shall be
vinyl siding, hardiboard or shake and brick or stone and shall coordinate with the
architectural style of the townhomes.
12. When the commercial buildings are developed, boulevard plantings and sidewalks
shall be provided along the north side of Victor Path, the east side of Leopold Lane,
and the sidewalk on the west side of Everton Avenue shall be extended to connect
with the County Road 8 Trial.
13. The applicant shall provide copies of the HOA documents/covenants for City review.
A copy of the covenants shall be filed with the final plat.
14. The homeowner's association documents shall include language to ensure that the
enclosed garage spaces are maintained for vehicle parking and that parking of
snowmobiles, boats, RVs and other recreational vehicles in the driveway is
discouraged. The covenants should be drafted to prohibit the storage of anything in
the garage or driveway that would prevent the storage and parking of vehicles. Such
language shall also be included in the Developers Agreement.
