FOR "VICTOR GARDENS 4TH ADDITION" ON PROPERTY LOCATED AT THE SOUTHWEST QUADRANT OF EVERTON AVENUE NORTH AND FRENCHMAN ROAD (COUNTY ROAD 8) WHEREAS, POAC-Crain, LLC. has requested approval of a preliminary plat to allow construction of 92 townhome units on the 23.64 -acre property legally described as follows: That part of the Southeast Quarter of the Northwest Quarter of Section 19, Township 31 North, Range 21 West, Washington County, Minnesota, lying Southerly of the center line of Frenchman road North (a/k/a County State Aid Highway No. 8). WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POAC---Crain, LLC for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 10 townhome lots, 9 common lots and 2 commercial lots in accordance with the plans and application received by the City on March 22, 2004, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the comprehensive plan amendment from Commercial to High Density Residential. 3. Approval is contingent upon City Council approval of the rezoning from C-2 to PUD. 4. Approval is contingent upon the City Council approval of the requested PUD amendment. 5. Development standards shall be as approved as part of the PUD. 6. The park dedication shall be cash -in -lieu of dedication and shall be due prior to filing the final plat. 7. The developer must obtain all necessary permits from Rice Creek Watershed District. 8. The development shall comply with the Fire Chief's requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. Resolution 2004-24 Page 2 9. The vacation of 146h Street must be finalized before filing the final plat. 10. Comply with all conditions outlined in the City Engineer's memo.
