APPROVING FINDINGS OF FACT FOR REZONING FOR PULTE HOMES OF
MINNESOTA FOR "WATERS EDGE SOUTH" ON PROPERTY LOCATED
EAST OF EVERTON AVENUE NORTH, SOUTH OF "WATERS EDGE
NORTH" AND NORTH OF COUNTY ROAD 8
WHEREAS, Pulte Homes of Minnesota have requested reclassification of the zoning
from Future Urban Reserve to PUD (planned unit development) for a 119.57 -acre parcel,
legally described as follows:
And
The north one-half of the northwest quarter of the northeast quarter of
Section 19, Township 31, Range 21 West
The northeast quarter of the southeast quarter and the southeast quarter of the
southeast quarter of Section 18, Township 31 north, Range 21 west, subject to the
right-of-way easements of the St. Paul and Duluth Railway and power lines.
According to the United States Government Survey thereof.
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from
Future Urban Reserve to PUD;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request
by Pulte Homes of Minnesota for the reclassification of the zoning from Future Urban
Reserve to PUD for the 119.57 -acre property, based on the following findings:
1. The proposed rezoning would be consistent with the Comprehensive Plan, which
allows medium density development (3-6 units per net acre) and other City
policies and plans. The development would allow townhomes at a net density of
4.9 units per acre.
2. The PUD will allow a more creative and efficient approach to land use within the
City, while at the same time protecting and promoting the health, safety, comfort,
aesthetics, economic viability and general welfare of the City.
3. The proposed development meets the intent of the PUD zoning district by
providing appropriate transitions between differing land uses within the site and
adjacent land uses, provides a landscaped parkway, regional water feature,
swimming pool/community room and other features.

4. The development would incorporate common design elements. The buildings
would have common design elements and similar landscape materials would be
used throughout the development and would be consistent with Waters Edge
North.
5. The developer is providing sidewalks and trails throughout the development to
connect to the City trail system. Additionally, the developer is providing a private
pool/community space as an amenity for the development residents.
6. There is adequate infrastructure to support the proposed rezoning and
development. The development extends the parkway to the south property line
and closes a portion of the gap between the parkway and County Road 8.
ADOPTED by the City Council this 17th day of May 2004.
