APPROVING PRELIMINARY PLAT FOR EMMERICH DEVELOPMENT
CORPORATION FOR "DIAMOND POINT WEST 2ND ADDITION" AND
"DIAMOND POINT WEST 3" ADDITION" ON PROPERTY LOCATED WEST
OF GOODVIEW AVENUE AND SOUTH OF 149H STREET
WHEREAS, Emmerich Development Corporation has requested approval of a
preliminary plat to allow construction of 46 homes on property legally described as
follows:
Outlots A, B and D, Diamond Point West, according to the recorded plat thereof,
Washington County, Minnesota.
AND
Government Lot 1, Section 29, Township 31 North, Range 21 West 100 feet and
except the south 600 feet thereof, according to the United States Government
Survey thereof, Washington County, Minnesota
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Emmerich Development Corporation for a preliminary plat, subject to the
following conditions:
1. A preliminary plat is approved to allow the creation of 39 single family lots in
Diamond Point West and 7 single family lots in Diamond Point West P Addition, in
accordance with the plans and application received by the City on March 3, 2004 and
revision received on April 5, 2004, except as amended by this resolution.
2. Approval is contingent upon the Goodview Avenue reconstruction.
3. Approval is contingent upon City Council approval of the PUD amendment and
rezoning from R-3 to PUD for the 3'd Addition.
4. Development standards shall be as approved as part of the PUD.
5. The applicant shall provide copies of the HOA documents/covenants for City review.
A copy of the covenants shall be filed with the final plat.
6. The HOA documents shall ensure that the private open space is preserved.

7. Sidewalks or trails shall be provided according the Park Commission
recommendation.
8. The developer shall provide details for decorative street lighting and signage. The
information shall be submitted for City review prior to issuance of building permits.
9. The right-of-way for all public streets shall be as indicated on the approved plans.
10. Public streets within the development shall be 30 feet in width (back to back).
11. The developer must obtain all necessary permits from the City, Rice Creek Watershed
District and Minnesota Department of Natural Resources.
12. The development shall comply with the Fire Chief's requirements regarding fire flow
calculations, the location of fire hydrants, fire department connections, and fire lane
signage.
13. The developer shall comply with all City requirements as noted in the comments from
the City Engineer.
14. Park Dedication shall be cash in lieu of land for Diamond Point West 3`d Addition.
Park Dedication for Diamond Point West VO Addition was met by park land
dedication in the Diamond Point East Addition.
15. No building permits shall be issued for Diamond Point 3'd Addition until Goodview
Avenue is reconstructed (i.e. graded with utilities installed).
