APPROVING FINAL PLAT FOR OAKWOOD LAND DEVELOPMENT, INC.
FOR BEAVER PONDS SOUTH ON PROPERTY LOCATED SOUTH OF 128TH
STREET AND NORTH OF 129H STREET
WHEREAS, Oakwood Land Development, Inc. has requested approval of a final plat to
allow construction of 43 homes on the 20.04 -acre property legally described as follows:
The southeast quarter of the northwest quarter of Section 32, Township
31, Range 21, except the south 652 feet thereof, Washington County,
Minnesota.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for Oakwood Land Development, Inc. for Beaver Ponds South; and
FURTHER, that the development agreement for said plat shall be completed by the City
Attorney and the Mayor and City Administrator be authorized to execute the
development agreement on behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved to allow the construction of 43 homes, in accordance with the
plans received by the City on April 22, 2004 and revisions received on June 11, 2004,
except as amended by this resolution.
2. The development agreement must be executed by the developer and the City prior to
release of the final plat.
3. Development standards shall be according to the preliminary plat approvals granted
by the City Council on April 5, 2004. The developer must comply with all conditions
of approval prior to issuance of building permits.
4. Final grading plans shall be submitted for review and approval by the City prior to
release of the final plat. Elevations should be shown on the comer of all units.
5. The developer must obtain all necessary permits from Rice Creek Watershed District.
6. The developer shall comply with all requirements from the City Engineer.

7. The park land dedication shall be dedicated to the City with the final plat.
8. The developer shall construct the parking lot in the City park, including bituminous
and curbing. The City shall reimburse the developer for the cost of the bituminous
and curbing.
9. The developer shall pay the City their share of the costs of the Beaver Ponds lift
station according to the existing agreement. The cost-sharing will be outlined in the
Developers Agreement.
10. Prior to filing the final plat, the developer shall provide the city with maintenance
agreements for maintenance of Outlot A.
