APPROVING A PUD AMENDMENT FOR POA-SCHERER, LLC. FOR "VICTOR
GARDENS SOUTH VILLAGE" ON PROPERTY LOCATED SOUTH OF
FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST OF EVERTON AVENUE
NORTH
WHEREAS, POA -Scherer, LLC has requested approval of a PUD Amendment to allow
construction of 14 townhomes and approximately 56,000 square feet of commercial on a
the 12.62 -acre property legally described as follows:
Oudot A, Victor Gardens 2°d Addition
And
Oudot A, Victor Gardens 3'd Addition
WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly
called Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by POA -Scherer, LLC for a PUD general plan amendment, subject to the
following conditions:
1. A PUD general plan/site plan is approved to allow the creation of 14 townhomes and
4 commercial lots in accordance with the plans received on June 11, 2004, except as
amended by this resolution.
2. Approval is contingent upon City Council approval of the requested preliminary plat.
3. Development standards for the PUD shall be as indicated on the plans dated June 11,
2004, except as amended by this resolution.
4. Commercial lots shall comply with the setbacks as shown on the plans.
5. All platted townhome lots shall comply with the following setbacks:
Front yard from public street
15 feet
Between buildings
20 feet
Setback around the perimeter of the site
exterior property lines
30 feet
6. A master sign plan shall be submitted for City review and approval prior to filing the
final plat.
7. Pavement and sidewalk detailing shall be as shown on the plans.
8. The sidewalk shall connect to the planned trail south of CSAH 8. The developer shall
work with the City and County to ensure these connections are made.

9. Building materials shall be as shown on the plans. The material samples shall be
submitted for City review and approval prior to final plat.
10. Staff will monitor the tenants within the development to ensure that adequate parking
is provided as tenants are finalized.
11. All building elevations shall receive equal treatment and visual qualities. There shall
be no underdeveloped backside to the buildings. Public entries and storefront
windows are encouraged on all building elevations.
12. The applicant shall provide copies of the development covenants for City review. A
copy of the covenants shall be filed with the final plat.
13. The homeowner's association documents shall include language to ensure that the
enclosed garage spaces are maintained for vehicle parking and that parking of
snowmobiles, boats, RVs and other recreational vehicles in the driveway is
discouraged. The covenants should be drafted to prohibit the storage of anything in
the garage or driveway that would prevent the storage and parking of vehicles. Such
language shall also be included in the Developers Agreement.
14. Private driveways in front of the townhome garages shall be 22 feet long to
accommodate parking.
15. Private streets serving the townhomes should be 22 feet wide where possible.
16. The developer shall provide different paving materials, signage or other treatment to
demarcate the private driveways.
17. Cross access and maintenance agreements shall be recorded with the final plat for the
shared private drives and parking.
18. The existing drainage and utility easement over the outlots shall be vacated prior to
final plat.
19. The applicant shall comply with all conditions from the City Engineer's memo dated
June 18, 2004.
