FOR "VICTOR GARDENS 5" ADDITION" ON PROPERTY LOCATED IN THE SOUTHEAST QUADRANT OF ELMCREST AVENUE AND FRENCHMAN ROAD WHEREAS, POA -Scherer, LLC has requested approval of a PUD Amendment to allow construction of 36 single-family homes and 5 outlots on an 83 -acre property legally described as follows: Oudot C, Victor Gardens 1"` Addition, according to the recorded plat thereof, Washington County, Minnesota, excepting therefrom, that part platted as Victor Gardens 2"d Addition, according to the recorded plat thereof, said Washington County, Minnesota WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA -Scherer, LLC for a PUD general plan amendment, subject to the following conditions: 1. A PUD general plan/site plan is approved to allow the creation of 36 single-family homes and 5 outlots in accordance with the plans received on June 25, 2004, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested preliminary plat. 3. The development is subject to the Victor Gardens PUD Concept approvals (Res. 2000-47). 4. The developer shall revise the plans to comply with the 65 -foot minimum lot width as shown on the July 12, 2004 concept. 5. Development standards are as follows: Minimum Front Yard Setbacks: House setback (traditional homes) 15 feet Garage setback front facie 25 feet Garage setback (side facing) 20 feet Side Yazd: Interior lot traditional homes 10 feet Interior lot (garages) 5 feet Corner lot (house) 15 feet Resolution 2004-53 Page 2 Comer lot (garage facing street) 25 feet Rear Yard: House traditional and cottage) 25 feet Garage (traditional and cottage) 5 feet From Clearwater Creek 100 feet 6. Building materials shall be as shown on the plans. The material samples shall be submitted for City review and approval prior to final plat. 7. PUD flexibility is granted to vary from the typical shoreland lot area and lot width requirements, based on the finding that: a. The proposed plat is consistent with the approved Victor Gardens PUD Concept plan. b. The applicant has proposed oudots adjacent to the creek, which will remain natural. c. The homes comply with the setback requirements. d. The City has an adopted stormwater management program that reduces the need for the larger lots and increased setbacks, which are intended to reduce runoff into the lakes. The stormwater management program adequately addresses this issue. e. The total impervious surface within the development will be less than 25 percent. f. The developer will implement BMPs (Best Management Practices) to ensure adequate protection of the lake during construction. g. The master plan for this development would comply with the purpose and intent of the shoreland requirements, which is to preserve the quality of the adjacent creek. 8. The applicant shall comply with all conditions from the City Engineer's memo dated June 30, 2004. ADOPTED by the City Council this 19th day of July 2004. ATTEST: Mary reager, City Cler
