FOR "VICTOR GARDENS 5TH ADDITION" FOR PROPERTY LOCATED IN THE SOUTHEAST QUADRANT OF ELMCREST AVENUE AND FRENCHMAN ROAD. WHEREAS, POA -Scherer, LLC. has requested approval of a preliminary plat to allow construction of 36 single-family homes and 5 outlots on an 83 -acre property legally described as follows: Outlot C, Victor Gardens 1 sc Addition, according to the recorded plat thereof, Washington County, Minnesota, excepting therefrom, that part platted as Victor Gardens 2"d Addition, according to the recorded plat thereof, said Washington County, Minnesota. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA -Scherer, LLC for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 36 single family lots and five outlots, one of which is to be dedicated to the City for park land, in accordance with the plans and application received by the City on June 25, 2004, except as amended by this resolution. 2. The park dedication land shall be deeded to the City with the final plat. 3. Street names shall be consistent with the approved Victor Gardens street naming system. 4. Sidewalks or trails shall be provided according the Park Commission recommendation. 5. The standard City bituminous trail section must be shown on the plan. 6. The trail must be adjusted slightly so that the entire trail remains in the common areas. 7. Trails may not be located within the floodway. 8. The floodplain and floodway must be shown on the plat. 9. The developer shall work with the City to revise the shape of the center island in the cul-de-sac at the end of Street B. Resolution 2004-54 Page 2 10. The developer shall revise the plans to comply with the 65 -foot minimum lot width as shown on the July 12, 2004 concept. 11. The wetlands must be blanketed by a drainage and utility easement. 12. The 300 -foot shoreland district must be shown on the plat. 13. The shoreland district's impervious calculations must be revised to include both sides of the' creek. 14. The existing easement over Outlot C is to be vacated. The applicant will need to provide proof of vacation prior to Final Plat approval. 15. The developer must obtain all necessary permits from Rice Creek Watershed District and Minnesota Department of Natural Resources. 16. The developer must prepare a staging plan, which outlines the number of sewer permits required each year throughout the development of the project. The plan must be submitted for review and approval by the City as part of the final plat. 17. The developer must construct units at a rate permitted by the MPCA, MCES and proceed in accordance with the approved staging plan and as allowed by available permits. 18. Valjean Boulevard should be terminated at its eastern limit with a temporary cul-de- sac. 19. The applicant shall comply with all conditions from the City Engineer's memo dated June 30, 2004.
