APPROVING A CONDITIONAL USE PERMIT FOR A WIND POWERED
GENERATOR AT 7310132ND STREET NORTH.
WHEREAS, Greg Johnson has requested a conditional use permit to allow for the
construction of a wind -powered generator
See Exhibit A
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Greg Johnson for a conditional use permit, subject to the following conditions:
1. The conditional use permit amendment is approved in accordance with the
application received by the City on May 4, 2004.
2. The tower shall be constructed as a monopole, be limited to 100 -feet in height, and
shall contain no antennas or other equipment not related to the generator.
3. Prior to erecting the tower, the applicant shall obtain a building permit.
4. Prior to the issuance of a building permit, information shall be provided to the City to
ensure compliance with the construction standards outlined in Section 1195-720.1,
Subd. 4 of the Comprehensive Land Use Regulations.
5. Prior to the issuance of a building permit, the applicant shall provide proof of liability
insurance in the amount of $500,000.
6. The generator shall be maintained in a state of good repair such that it will not
generate usually high levels of noise. If at any time, the generator produces usually
high levels of noise, the generator shall be turned off until satisfactory repairs have
been made.
