APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA
SCHERER, LLC FOR VICTOR GARDENS SOUTH VILLAGE ON PROPERTY
LOCATED SOUTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST
OF EVERTON AVENUE NORTH.
WHEREAS, POA -Scherer, LLC of Minnesota has requested approval of a Final Plat for
"Victor Gardens South Village" on property legally described as follows:
Outlot A, Victor Gardens 2nd Addition
And
Oudot A, Victor.Gardens. P Addition
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for POA -Scherer, LLC for Victor Garden South Village, and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved to allow the construction of 14 townhome units, 4
commercial lots, and two outlots in accordance with the plans received by the
City on August 30, 2004, except as amended by this resolution.
2. The development agreement must be executed by the developer and the City prior
to release of the final plat.
3. Cross access and maintenance agreements shall be recorded with the final plat for
all shared private driveways or streets.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. HOA documents must be filed at Washington County.
2. The plans must be revised to comply with all conditions in the City Engineer's
memo dated September 1, 2004.

3. Revise the plans to provide a convenient trash enclosure or, preferably, an
internal trash enclosure for the small retail building "C".
4. Revised the plans to provide private driveways that are 22 feet in length The
dimensions of each and every driveway must be shown on the plan.
5. There are two parking lot lights (one in the east lot and one in the west lot),
which could be obstructed by full-grown Skyline Honey locusts. These four
honey locust should be replaced with Red Jewel Crabs (or other smaller
ornamental trees) so that the light fixtures are not obstructed by tree branches in
the future.
6. Comply with all conditions of the PUD amendment approved on July 6, 2004.
