RESOLUTION 2004-69
APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PRATT
INVESTMENT AND CENTEX HOMES FOR "HERITAGE PONDS" ON
PROPERTY LOCATED EAST OF ELMCREST AVENUE, WEST OF EVERTON
AVENUE AND NORTH OF COUNTY ROAD 8
WHEREAS, Pratt Investments and Centex Homes have requested approval of a Final
Plat for "Heritage Ponds" on property legally described as follows:
The southwest quarter of the northwest quarter and the north half of the southwest
quarter, Section 18, Township 31 North, Range 21 West, located in Washington
County, Minnesota.
Together with
The southeast quarter of the northwest quarter of Section 18, Township 31 North,
Range 21 West, Washington County, Minnesota.
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for Pratt Investments and Centex Homes for Heritage Ponds; and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved to allow the construction of phase I, in accordance with
the plans received by the City on September 13, 2004, except as amended by this
resolution.
2. The development agreement must be executed by the developer and the City prior
to release of the final plat.
3. Development standards shall be according to the PUD general plan and
preliminary plat approvals granted by the City Council on May 3, 2004, and as
may be amended.
4. Cross access and maintenance agreements shall be recorded with the final plat for
all shared private driveways or streets.

5. Drainage and utility easements shall be recorded with the final plat for all private
driveways.
6. The land proposed for park dedication and the school/community playfields
(Outlots B and F) shall be deeded to the City with the final plat for the first phase
of the development.
7. The final plat must be revised to rename 150 Street North to Heritage Parkway.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. The applicant shall submit the final design palette for the entire project, including
material samples for the siding, shakes, shutters, shingles, brick and stone, for
City review and approval.
2. The developer must provide a copy of the HOA documents for City review and
approval. The HOA documents must include architectural guidelines.
3. The applicant must file the HOA documents at Washington County.
4. The developer shall provide a master sign plan for City review and approval.
5. The developer shall work with the City to establish guidelines for crosswalks.
The plans should be revised to provide crosswalks perpendicular to the streets
near the school site, including at Promontory Point, the intersection of
Heritage/Europa, 158"/Enfield and Heritage/Empress.
6. The plans must be revised to coordinate with the Waters Edge North plans for
Heritage Parkway with a trail on the south and a sidewalk on the north.
7. 158`h Street (formerly Street A) must be revised to provide a 32 -foot wide street.
8. The applicant will be required to obtained easements or encroachment agreement
from the property owner to the north to allow construction of 158h Street in the
2°d phase of development.
9. The applicant must pave Elmcrest Avenue from County Road 8, the first lift of
which must be completed prior to issuance of Certificates of Occupancy.
10. The Developer is required to escrow one-half of the cost to upgrade Ehmcrest
Avenue to an urban -section roadway along the edge of the plat, with credit given
for expense related to the paving proposed as part of the current development.
This issue is outlined in the Development Agreement.

11. The applicant shall pay their portion of the Everton Avenue Study AUAR costs,
based on the area of the project site.
12. The plans must be revised to comply with all conditions in the City Engineer's
memo dated September 15, 2004.
13. One full set of final, approved plans shall be submitted to the City.
