APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE
HOMES FOR WATERS EDGE SOUTH ON PROPERTY LOCATED EAST OF
EVERTON AVENUE NORTH IN THE NORTHEAST QUADRANT OF
SECTION 18, TOWNSHIP 31, RANGE 21
WHEREAS, Pulte Homes of Minnesota have requested approval of a Final Plat for
"Waters Edge South" on property legally described as follows:

WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE TT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for Pulte Homes for Waters Edge South; and -
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved in accordance with the revised plans received by the City
on September 24, 2004, except as amended by this resolution.
2. The development agreement must be executed by the developer and the City prior
to release of the final plat.
3. Development standards shall be according to the rezoning, PUD general plan and
preliminary plat approvals granted by the City Council on May 17, 2004, and as
may be amended.
4. HOA documents must be filed with the final plat at Washington County.
5. Cross access and maintenance agreements shall be recorded with the final plat for
all shared private driveways or streets.
6. Drainage and utility easements shall be recorded with the final plat for all private
drives.
7. The Xcel Energy pipeline easement must be filed with the final plat.

8. Park dedication shall be cash in lieu of fees due at the time of release of final plat
for filing (143 lots x $1800 = $257,400).
9. The developer shall pay their share of the Everton Avenue AUAR costs.
10. The outlots for the potential future well sites shall be deeded to the City of Hugo
with the final plat.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. The plans must comply with all conditions in the City Engineer's memo dated
September 29, 2004.
2. Submit one full set of the approved plans to the city prior to issuance of building

3. The site plan shall be revised to identify setbacks for the homes and community
building.
4. The grading plans shall be revised to show sidewalk details like Waters Edge
North.
5. The grading plans show grading off-site adjacent to the southern border of the
site. The applicant must obtain easements from the adjacent landowner(s) prior
to beginning any work in this area.
6. Sidewalk details shall be submitted like Waters Edge North.
7. The community building shall be designed to be architecturally compatible with
the homes. A final site plan must be submitted for review and approval by City
staff.
8. The lighting plan must be revised to identify the revised streets surrounding the
community center area.
9. The landscape plans shall be revised to locate irrigation in the parkway
landscaping.
10. The developer and the City shall work together to ensure completion of the
parkway to CSAH 8.
11. Everton Avenue must be paved to the north boundary of the Waters Edge South
property adjacent to Everton Avenue, as required as part of the preliminary plat.

12. The development shall comply with the Fire Chief s requirements regarding fire
flow calculations, the location of fire hydrants, fire department connections, and
fire lane signage.
