APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA-
SCHERER, LLC. FOR VICTOR GARDENS 5t6 ADDITION ON PROPERTY
LOCATED EAST OF EVERTON AVENUE NORTH AND SOUTH OF
FRENCHMAN ROAD
WHEREAS, POA -Scherer, LLC. has requested approval of a Final Plat and Development
Agreement for "Victor Gardens P Addition" on property legally described as follows:
Oudot C, Victor Gardens 1" Addition, according to the recorded plat
thereof, Washington County, Minnesota, excepting therefrom, that part
platted as Victor Gardens 2°d Addition, according to the recorded plat
thereof, said Washington County, Minnesota.
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for POA -Scherer, LLC for Victor Gardens 5" Addition; and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved in accordance with the plans and application received by
the City on August 18, 2004 and revised on September 20, 2004, except as
amended by this resolution.
2. The placement of fill material in the floodway is prohibited. The grading plan
should be revised to eliminate any grading within the area. The silt fence should
be located outside of the floodway to protect it from grading impacts due
to construction of the proposed trail.
3. HOA documents must be filed at Washington County with the final plat.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. Development standards shall be according to the rezoning, PUD general plan and
preliminary plat approvals granted by the City Council on May 3, 2004.
2. The developer shall work with the City to revise the shape of the center island in
the cul-de-sac at the end of Street B.

3. The plans must be revised to comply with all conditions in the City Engineer's
memo dated September 29, 2004.
4. One full set of the approved plans must be submitted to the city.
ADOPTED by the City Council this 4m day of October 2004.
