HomeMy WebLinkAbout2004.11.01 RESO 2004-0081RESOLUTION 200481 APPROVING FINDINGS OF FACT DENYING VARIANCE TO FOR A SIDE YARD SETBACK FOR A GARAGE ADDITION AT 5995138TH STREET NORTH WHEREAS, Mike and Diane Hankee have requested a variance to locate a garage eight feet from the side property line where ten feet is required by ordinance on property described as follows: Lot 10, Block 4, Hugo Meadows, Washington County. WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at a duly called public meeting, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variance requested by Mike and Diane Hankee for property located at 5995 138th Street based on the following findings: 1. The applicant has not identified a unique hardship that would warrant the granting of the requested variances. 2. The strict enforcement of the ordinance would not cause undue hardship because the applicant would be able to construct a garage addition of reasonable size. 3. The applicant's desire to increase the garage is a self-created hardship and is not unique to this individual parcel. 4. The spirit and intent of the ordinance would not be met because the entire length of the proposed garage would extend two feet into the required setback, reducing the amount of open space intended by the ordinance. 5.
