APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR
EMMERICH DEVELOPMENT CORPORATION FOR DIAMOND POINT WEST
3" ADDITION ON PROPERTY LOCATED WEST OF GOODVIEW AVENUE
AND SOUTH OF 145'b STREET
WHEREAS, Emmerich Development Corporation has requested approval of a Final Plat
for "Diamond Point West 3'd Addition" on property legally described as follows:
Outlot B, Diamond Point West 2"d Addition, Washington County,
Minnesota
And
That part of Outlot A, Diamond Point West 2"d Addition, according to the
recorded plat thereof, Washington County, Minnesota, lying southerly of
the line described as follows:
Commencing at the southeast corner of said Outlot A; thence on an
assumed bearing North 0 degrees 38 minutes 56 seconds East, along the
east line of said Outlot A, a distance of 30.49 feet to the point of
beginning of the line to be described; thence westerly a distance of 30.77
feet along a non-tangential curve concave to the north having a radius of
65.89 and a central angle of 26 degrees 45 minutes 36 seconds, a chord
bearing of north 74 degrees 25 minutes 14 seconds west and a chord a
distance of 30.49 feet; thence north 61 degrees 02 minutes 26 seconds
west, tangent to said curve, a distance of 64.90 feet thence westerly a
distance of 150.12 feet along a tangential curve concave to the south
having a radius of 345.95 feet and a central angle of 24 degrees 51
minutes 44 seconds; thence north 85 degrees 54 minutes 10 seconds
west a distance of 29.21 feet to a westerly line of said Outlot A and said
line there terminating.
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does yprove the Final
Plat for Emmerich Development Corporation for Diamond Point West 3 Addition; and
FURTHER, that the development agreement for said final plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City, and
FURTHER, that the following conditions be met prior to recording the final plat:

1. A final plat is approved to allow the construction of 7 single-family homes in
accordance with the plans received by the City on November 22, 2004 and
December 2, 2004 except as amended by this resolution.
2. Development standards shall be according to the rezoning, PUD amendment and
preliminary plat approvals granted by the City Council on May 17, 2004 and as
may be amended.
3. Park dedication requirements for Diamond Point West 3'd Additional shall be cash
in lieu of land for the 7 lots.
4. The development agreement must be executed by the developer and the City prior
to release of the final plat.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. HOA documents must be filed at Washington County.
2. The HOA documents must insure that the private open space is preserved by the
Homeowners Association.
3. Details for decorative street lighting, development signage and street/directional
signage must be submitted.
4. The five-foot wide bike lane shall be constructed on Geneva Avenue and clearly
marked according to City standards.
5. The City shall retain discretion to withhold all permits or approvals in the event
that satisfactory progress is not made on the design and development of
Goodview Avenue and Development Agreement shall so state.
6. The plans must be revised to comply with all conditions in the City Engineer's
memo dated December 14, 2004.
7. One full set of the approved plans must be submitted to the city.
