HomeMy WebLinkAbout2004.12.20 RESO 2004-0092RESOLUTION 2004-92 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR WATERS EDGE NORTH SF, LLC FOR WATERS EDGE SECOND ADDITION WHEREAS, Waters Edge SF, LLC has requested approval of a Final Plat for "Waters Edge Second Addition" on property legally described as follows: Outlot B and Outlot G, Waters Edge, Washington County, Minnesota according to the plat thereof WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Waters Edge SF, LLC for Waters Edge Second Addition; and FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow the construction of 64 single family homes, in accordance with the plans received by the City on November 3, 2004 and revisions received on December 3, 2004, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City prior to release of the final plat. 3. Development standards shall be according to the PUD general plan and preliminary plat approvals granted by the City Council on December 15, 2003, and as may be amended. 4. The architectural controls shall be finalized for City review and filed with the HOA documents. 5. The developer must provide easement documents for off-site construction of the parkway. 6. The plans must be revised to comply with all conditions in the City Engineer's memo dated December 14, 2004. 7. Drainage and utility easements shall be provided as noted in the City Engineer's memo dated December 14, 2004. FURTHER, that the following conditions be met prior to issuance of building permits: Resolution 2004-92 Page 2 1. No changes shall be made to the HOA documents unless approved by the City of Hugo in writing. Any amendments to the HOA documents must be filed at Washington County. 2. No construction access will be permitted off 150 Avenue. The developer shall provide language to this effect in their contracts with all builders and subcontractors.
