A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF HUGO, WASHINGTON
COUNTY, MINNESOTA, AUTHORIZING CREATING COMMUNITY REPRESENTATIVE
OFFICES AND ESTABLISHING POLICIES AND RESTRICTING GOVERNING THE USE
THEREOF
Whereas, The City of Hugo has constructed a new City Hall which has been designed to
accommodate the demands for space required by the Citizens of Hugo, City Council and City
Staff in future years; and
Whereas, at this time, the City Hall has two offices, which are not presently in use but
which. will be used by City Staff in the future. The City Council is desirous of making interim
use of the offices in a way which will provide a direct and material public service to the Citizens
of Hugo; and
Whereas, it is the intention of the City Council to permit these offices be designated
"Community Representative Offices", the use of which shall be limited to the persons or firms
enumerated below and which use shall be directed at providing a direct and material benefit to
the Citizens of the City of Hugo; and
Whereas, the City Council is desirous of establishing guidelines and restricting the use of
these offices.
NOW THEREFORE, the City Council of the City of Hugo establishes the following
regulations for the use of Community Representative Offices:
1. Persons or organizations using the Community Representative Offices shall execute a
written lease for same, to be approved by the City Council, which lease shall be short
term and shall require payment of rent to the City in an amount equivalent to the then
current market rates for the Hugo area as determined by the Hugo City Assessor. In
addition, said rental shall be sufficient to defray any utility expense which is expected to
be allocable to the Community Representative Office. The Offices shall be made
available on a "first come first served basis" subject, always, to the restrictions set forth
herein. City Staff shall maintain a list of persons or organizations that desire to lease a
Community Representative Office and shall notify them as availability occurs.
2.* Use of the Offices shall be approved by the City Council and limited to persons or
organizations which provide a significant representative service to, or which conduct
regulatory activities within, the City of Hugo and which are non-profit (hereinafter:
"Community Representative Lessees" or "Lessees"). Examples of such organizations
include, but may not be limited to, watershed or soil conservation agencies, farm bureau
or agricultural service agencies, law enforcement agency, state construction or
environmental, regulatory or enforcement office, branch offices of any state, county or
federal representative, office or agency, license bureau, emergency response or
preparedness office, armed forces or veteran's service office.
3. Community Representative Lessees shall not utilize city office equipment, supplies,
materials or outgoing mailing service. Lessees shall be furnished three chairs, a table and
file cabinet. Lunchroom and conference room space may be utilized by Lessees, subject
always, however, to the City's use of those areas. Telephone, computer and data system
wiring shall be dedicated to the leased premises. Lessees shall not utilize City staff or
employees in the performance of their work nor shall any one Lessee occupy any more
than one of the two Community Representative Offices.
4. Lessees shall not utilize the leased space or equipment for any prohibited or unlawful
purpose, any use which would interfere with or disturb the staff, employees or other users
of the City Hall or political fundraising or campaign purposes. Lessees shall maintain,
and upon request furnish, documents sufficient to permit the City to confirm that no
activity which is prohibited by this policy, or the lease terms, is occurring on the leased
premises. In the event that any prohibited or unlawful purpose is determined to have
occurred, then any lease shall be terminated immediately without loss, cost, and damage
to the City of Hugo.
5. Lessees shall exercise reasonable care to ensure that their guests, employees, visitors, or
invitees are accompanied by Lessees representatives while within City Hall.
6. The City of Hugo shall bear no liability, loss, costs, expense or damage to any of Lessees
property, equipment or materials by reason of theft, loss, damage by any person or cause
whatsoever.
7. A copy of this resolution shall be attached as an exhibit to any Community
Representative Lease and shall be incorporated therein.
WHEREUPON, a vote being taken upon the motion, the following members voted in favor.
Mike Granger, Becky Petryk, Frank Puleo, and Fran Miron
and the following voted against: NONE
WHEREUPON, said motion was declared duly passed and adopted by the City Council this
21 st day of January, 2003.
