RESOLUTION 2003-3
APPROVING PUD AMENDMENT FOR POA/SCHERER, LLC. FOR VICTOR
GARDENS 3r4 ADDITION ON PROPERTY LOCATED SOUTH OF CSAH 8 AND
EAST OF EXISTING ELMCREST AVENUE NORTH
WHEREAS, POA/Scherer, LLC. has requested approval of a PUD amendment to allow
construction of 99 townhomes on property legally described as follows:
Outlot B, Victor Gardens, according to the recorded plat thereof, Washington
County, Minnesota
WHEREAS, the Planning Commission has reviewed the PUD amendment at a duly
called Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the PUD
amendment for POA/Scherer, LLC on property located south of CSAH 8 and east of
Elmcrest Avenue, subject to the following conditions:
1. A PUD concept plan is approved to allow construction of a 99 townhome units on 13
lots, two common lots and two outlots, in accordance with the plans and application
received by the City on December 9, 2002 and December 20, 2002, except as
amended by this resolution.
2. The development shall be consistent with Victor Gardens PUD concept plan
approvals (Resolution 2000-47), except as otherwise noted.
3. All platted townhome lots shall comply with the following setbacks:
Front yard from public street
15 feet
Between buildings
20 feet
Setback around the perimeter of the site
exterior property lines
30 feet
From commercial property line
15 feet

4. The applicant shall obtain all necessary local, state, and federal permits.
5. The applicant shall develop and implement architectural review and design guidelines
for all townhome buildings. The buildings materials would be maintenance free and
would include stone accents on the main level, vinyl lap and shake siding and asphalt
roofing.

Commercial Development
6. Site plan approval is required for the commercial development planned for Outlot A.
No development approvals for the commercial site are granted or implied.
7. Commercial development on Outlot A shall comply with all conditions of the Victor
Gardens PUD approvals.
8. Elevations of all sides of a proposed commercial building shall be submitted with the
site plan for determination of compliance with the above requirements.
9. Appropriate transitions must be provided between the townhomes and the planned
commercial development.
10. Sidewalks shall be. provided on the adjacent public streets.
Landscaping/Lighting
11. The landscape plan shall be revised to comply with City requirements, including
location, number and species of proposed landscaping. The revised plan shall be
submitted for staff review.
12. Boulevard trees shall be planted along both sides of the public streets. The trees shall
be planted at a minimum of 50 feet on -center. Within the gas line easement,
ornamental trees may be used.
13. The applicant shall provide the appropriate transitions and buffers from adjacent
properties. The transitions and buffers shall take into account the existing zoning of
the adjacent parcels.
14. Exterior lighting shall be consistent throughout the development. All lighting shall be
shielded to prevent glare and light trespass, as required by Section 6.37 of the
ordinance.
15. A comprehensive sign plan shall be submitted for Planning Commission review and
City Council approval prior to erecting any signage on the property.

Streets, Sidewalks and Utilities
16. The public. street (Street A) shall be increased to 28 feet wide (face to face) with
parking on one side. The applicant shall work with City staff to finalize the street
design prior to final plat approval.
17. Prior to final plat, the applicant shall provide the City the necessary written approvals
from Koch Pipeline Company for the encroachments into the existing gas line
easement. The approvals must allow the City to encroach into the gas line easement
for any required work in the public right-of-way for Street A.
18. The developer shall provide B6-18 barrier curb on all public streets.
19. The private driveways serving the townhome units shall be a minimum of 21 feet
long, but should be 22 feet long where possible.
20. Shared driveways serving the townhome buildings may be reduced to 20 feet wide.
Driveway J connecting to Street A shall remain 22 feet wide.
21. No parking is permitted on the shared driveways.
22. The developer shall incorporate different paving materials, signage or some other
treatment to demarcate the shared driveways.
23. The developer shall identify additional locations for guest parking in order to provide
convenient guest parking for all townhomes.
24. Sidewalks shall be provided along Driveway G, H and J and shall be extended to
Street A, where mid -block connections will be provided to the sidewalk on the east
side of Street A. The developer shall work with staff to determine the final locations.
25. Pedestrian connections must be provided between the townhomes on Block 2 and the
planned commercial development.
26. Cross access and maintenance agreements shall be recorded with the final plat for all
shared private driveways or streets.
27. The development shall comply with the Fire Chiefs requirements regarding fire flow
calculations, the location of fire hydrants, access, fire protection and fire lane signage.
Drainage/Stormwater Management
28. The applicant shall obtain approval of the land development plan by the Rice Creek
Watershed District.

29. A portion of the development lies within the Floodplain Overlay District. The
developer shall obtain all necessary permits and approvals for the floodplain impacts.
30. The applicant shall submit a landscaping plan that includes native grasses, flowers,
shrubs, and trees near the wetlands, ponds, and Clearwater Creek. The purpose of the
native vegetation is to encourage infiltration.
31. All homes and structures shall be set back a minimum of 100 feet from Clearwater
Creek.
32. A fence or wall must be provided on top of the six-foot retaining wall shown on
Outlot B near Driveway J.
33. The developer shall comply with all requirements from the City Engineer and City
Water Resources Engineer.
