APPROVING PRELIMINARY PLAT FOR POA/SCHERER, LLC. FOR VICTOR
GARDENS 3'" ADDITION ON PROPERTY LOCATED SOUTH OF CSAH 8 AND
EAST OF EXISTING ELMCREST AVENUE NORTH
WHEREAS, POA/Scherer, .LLC. has requested approval of a preliminary plat to allow
construction of 99 townhomes on property legally described as follows:
Outlot B, Victor Gardens, according to the recorded plat thereof, Washington
County, Minnesota
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
preliminary plaf for POA/Scherer, LLC on property located south of CSAH 8 and east of
Ehncrest Avenue, subject to the following conditions:
1. A preliminary plat is approved to allow the construction of 99 townhomes on 13 lots,
two common lots and two outlots, in accordance with the plans and application
received by the City December 9, 2002 and December 20, 2002, except as amended
by this resolution.
2. Approval is contingent upon City Council approval of the PUD amendment.
3. Development standards shall be as approved as part of the PUD.
4. The developer shall revise the preliminary plat to clearly identify the outlot lot lines.
5. All platted townhome lots shall comply with the following setbacks:
Front yard from public street
15 feet
Between buildings
20 feet
Setback around the perimeter of the site
exterior property lines
30 feet
From commercial property line
15 feet
Required • parking for townhomes
(including garage stalls
2.5 stalls per unit
6.. The right-of-way for public streets shall be 50 -feet wide.
7. The public street (Street A) shall be increased to 28 feet wide (face to face) with
parking on one side. The applicant shall work with City staff to finalize the street
design prior to final plat approval.

8. Prior to final plat, the applicant shall provide the City the necessary written approvals
from Koch Pipeline Company for the encroachments into the existing gas line
easement. The approvals must allow the City to encroach into the gas line easement
for any required work in the public right-of-way for Street A.
9. The developer shall provide B6-18 barrier curb on all public streets.
10. The private driveways serving the townhome units shall be a minimum of 21 feet
long, but should be 22 feet long where possible.
11. Shared driveways serving the townhome buildings may be reduced to 20 feet wide.
Driveway J connecting to Street A shall remain 22 feet wide.
12. No parking is permitted on the shared driveways.
13. The developer shall incorporate different paving materials, signage or some other
treatment to demarcate the shared driveways.
14. Boulevard plantings must be provided on both sides of Street A.
15. Sidewalks shall be provided along Driveway G, H and J and shall be extended to
Street A, where mid -block connections will be provided to the sidewalk on the east
side of Street A. The developer shall work with staff to determine the final locations.
16. Pedestrian connections must be provided between the townhomes on Block 2 and the
planned commercial development.
17. Cross access and maintenance agreements shall be recorded with the final plat for all
shared private driveways or streets.
18. The plans shall note the ordinary high water and 100 -year high water elevation for all
water bodies.
19. The plans must identify normal water level, high water level and emergency overflow
for the ponds.
20. Utility plans and details must be submitted.
21. The development shall comply with the Fire Chief's requirements regarding fire flow
calculations, the location of fire hydrants, access, fire protection and fire lane signage.
22. A fence or wall must be provided on top of the six-foot retaining wall shown on
Outlot B near Driveway J.

23. The developer must obtain all necessary permits from Rice Creek Watershed District.
24. The developer shall comply with all requirements from the City Engineer and City
Water Resources Engineer.
