APPROVING A LOT SPLIT FOR DON HAUBLE ON PROPERTY LOCATED
NORTH OF 125m STREET AND EAST OF HIGHWAY 61.
WHEREAS, an application has been filed by Don Hauble that requests approval of a lot
split for property located north of 12P Street and east of Highway 61;
WHEREAS, the subject property is legally described as follows:

WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the lot
split for Don Hauble, subject to the following conditions:
1. A lot split is approved in accordance with the plans and application received by the
City on January 13, 2003, except as amended by this resolution.
2. The property is subject to the development standards of the R-3 zoning district.
3. The City code requires new lots in the MUSA to be served by municipal utilities. The
applicant may either pay a cash escrow for the future road and utility improvements,
or enter into an assessment agreement for the future improvements. The assessment
agreement, among other things, will require the property to waive all rights to appeal
any future assessments under Minnesota Statues 429.
4. Prior to recording the subdivision, the developer shall pay the park dedication fees in
lieu of land dedication, pursuant to the Dedication Policy in effect at the time of
recording the subdivision. Park dedication fees shall only apply to the eastern lot.
