APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR
POA/SCHERER, LLC. FOR VICTOR GARDENS P ADDITION ON PROPERTY
LOCATED SOUTH OF CSAH 8 AND EAST OF EXISTING ELMCREST AVENUE

WHEREAS, POA/Scherer, LLC. has requested approval of a final plat to allow
construction of 99 townhomes on property legally described as follows:
Outlot B, Victor Gardens, according to the recorded plat thereof, Washington
County, Minnesota
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for POA/Scherer, LLC for Victor Gardens P Addition; and
FURTHER, that the development agreement for said plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved to allow the construction of 99 townhomes on 13 lots, two
common lots and two outlots, in accordance with the plans and application received
by the City February 28, 2003, except as amended by this resolution.
2. The development agreement must be executed by the developer and the City prior to
release of the final plat.
3. Approval of the final plat is contingent upon vacation of the existing drainage and
utility easement over Outlot B, Victor Gardens.
4. Development standards shall be according to the PUD general plan and preliminary
plat approvals granted by the City Council on January 21, 2003. The developer must
comply with all conditions of approval prior to release of the final plat.

5. For pedestrian safety, the developer should consider installation of a fence or wall on
top of the retaining wall shown on Outlot B near Driveway J.
6. Pedestrian connections must be provided between the townhomes on Block 2 and the
planned commercial development.
7. The developer must obtain all necessary permits from Rice Creek Watershed District.
8. Utility plans and details must be submitted for review and approval by City staff prior
to release of the final plat.
9. Final construction plans, including drainage documents, must be submitted for review
and approval by City staff prior to release of the final plat.
10. The developer shall comply with all requirements from the City Engineer and City
Water Resources Engineer.
