RESOLUTION 2003-19
APPROVING FINDINGS OF FACT FOR REZONING FOR HERITAGE
DEVELOPMENT FOR "EAGLE SHORES" ON PROPERTY LOCATED NORTH
OF 122ND STREET AND WEST OF EVERTON AVENUE
WHEREAS, Heritage Development has requested reclassification of the zoning from R-1
(large lot single family residential) to PUD (planned unit development) for a 12.16 -acre
parcel, legally described as follows:
Outlots C, H, I and J, Lake Estates, Washington County, Minnesota
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from
R-1 to PUD;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request
by Heritage Development for the reclassification of the zoning from R 1 to PUD for the
12.16 -acre property, based on the following findings:
1. The proposed rezoning is consistent with the Comprehensive Plan and other City
policies and plans. The development would allow single-family detached homes at a
net density of 0.9 units per acre, which is consistent with the Comprehensive Plan and
Zoning Ordinance requirements.
2. The proposed development meets the intent of the PUD zoning district by providing
smaller lots served by sanitary sewer where septic systems would be allowed while
maintaining a net density of approximately one unit per acre. The sanitary sewer
would reduce potential negative impacts on the nearby Bald Eagle Lake that could be
caused by a concentration of septic systems.
3. The PUD will allow a more creative and efficient approach to land use within the
City, while at the same time protecting and promoting the health, safety, comfort,
aesthetics, economic viability and general welfare of the City. The PUD allows the
developer to provide smaller lots --while maintaining a net density of one unit per
acre --in exchange for extending sanitary sewer to serve the site and providing an
oversized storm sewer system that could be used to address the existing drainage
issues east of the subject site. Additionally, the PUD allows the developer to place
the public street in the center of site, rather than on the east property line as originally
proposed. Construction of the road in the middle of the site would allow the
developer to plat the property without creating double frontage lots in the adjacent
Lake Air Estates.

4. The proposed development meets the intent of the PUD zoning district by creating an
integrated neighborhood, lifecycle housing opportunities, preservation of natural
resources and provision for sanitary sewer and storm water management that would
not otherwise be possible through a strict interpretation of the Zoning Ordinance. The
developer has shifted the development east to allow preservation of the trees on the
western property line. Additionally, the developer worked with the City to provide a
storm water management system that is over -sized to address the existing drainage
issues east of this site.
5. The proposed density would be consistent with the PUD standards. The development
would be compatible with the adjacent existing single family homes.
6. The development would provide a higher level of design in the PUD by providing
decorative street lighting, a private trail within the development, tree preservation,
extension of sanitary sewer where septic systems would be allowed and an over -sized
storm water management system that could help address existing drainage issues in
the neighborhood.
7. There is adequate infrastructure to support the proposed rezoning and development.
The developer will extend sanitary sewer to serve the site.
