APPROVING PRELIMINARY PLAT FOR HERITAGE DEVELOPMENT FOR
"EAGLE SHORES" ON PROPERTY LOCATED NORTH OF 122ND STREET
AND WEST OF EVERTON AVENUE
WHEREAS, Heritage Development has requested approval of a preliminary plat to allow
the creation of 11 lots on this 12.16 -acre site legally described as follows:
Outlots C, H, I and J, Lake Estates, Washington County, Minnesota
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Heritage Development for a preliminary plat, subject to the following
conditions:
1. A preliminary plat is approved to allow the creation of 11 single family lots, in
accordance with the plans and application received by the City on February 14, 2003
and revisions received on March 19, 2003, except as amended by this resolution.
1. Approval is contingent upon City Council approval of the rezoning from R 1 to PUD
and PUD general plan.
2. Development standards shall be as approved as part of the PUD.
3. The applicant shall provide copies of the HOA documentstcovenants for City review.
A copy of the covenants shall be filed with the final plat.
4. The right-of-way for the public street shall be 50 feet.
5. The public street may be reduced to 24 feet in width (back to back).
6. The applicant shall work with staff to shift the road within the right-of-way to ensure
that adequate space is preserved within the right-of-way for future installation of
municipal water.
7. All private utilities shall be located on the opposite side of the right-of-way from the
planned municipal water service.
8. The applicant shall provide 30 -foot wide easements between Lots 3 and 4 and
between Lots 5 and 6 to accommodate future watermain looping.

9. The applicant may either pay a cash escrow for the future municipal water
improvements, or enter into an assessment agreement for the future improvements.
The assessment agreement, among other things, will require the property to waive all
rights to appeal any future assessments under Minnesota Statues 429.
10. Drainage and utility easements (6 -foot side and 12 -foot front and rear, except as
otherwise noted) shall be recorded with the final plat.
11. Easements for the storm sewer outlet west of this site shall be shown on the
preliminary plat.
12. The applicant shall obtain approval of the land development plan by the Rice Creek
Watershed District and the Department of Natural Resources, including the proposed
discharge into Bald Eagle Lake.
13. The City will reimburse the developer for the cost of increasing the size of the storm
sewer to 24 -inches and V2 of the cost of 122nd Street reconstruction. The cost of the
City participation should be based on the actual construction costs for the proposed
pipe upsizing and street replacement cost. The City participation shall not exceed the
$27,824.00 amount indicated in the cost participation calculation.
14. The applicant shall work with the City to finalize the alignment of the storm sewer
proposed in 122nd Street.
15. Easements must be provided over the infiltration ponds shown in the rear yards of
Lots 6, 7, 8 and 9.
16. The storm sewer easement needed for extension of the storm sewer outlet west of this
site must be shown on the site plan and preliminary plat.
17. The applicant shall be responsible for obtaining the 30 -foot easement required to
extend the storm sewer system to discharge into Bald Eagle Lake.
18. The plat shall comply with the City's street naming system, except as otherwise
approved by the City Council.
19. The developer must obtain all necessary permits from Rice Creek Watershed District
and the Department of Natural Resources.
20. The development shall comply with the Fire Chief s requirements regarding fire flow
calculations, the location of fire hydrants, fire department connections, and fire lane
signage.
21. The developer shall comply with all City requirements from the City water resource
engineer and the City Engineer.

22. Park dedication shall be fees -in -lieu of dedication for the 10 new lots. Park
dedication fees will be due prior to release of the final plat for recording.
